If the agreement had been to bar blacks, would the agreement stand? Of course not. Civil rights would trump $1 rental agreements. You undoubtedly find this to be a flawed comparison, but many others do not. So the disagreement continues.
A flawed comparison doesn't even begin to cover it. What you fail to realize is that chosen behavior doe not equal racial differences. Under your comparison, any chosen behavior should be protected, endorsed and forced upon us by the power of government. The Supreme court has upheld the constitutionality of the Scout's policy. BTW, Philly apparently didn't have ANY problems with that policy since, what was it, 1980s when the 'law' was passed.

What 'public tax dollars' are they receiving - NONE. They are paying utilities and up keep. That they pay $1 doesn't matter, similar arrangements are with other organizations for sure. So I guess we need to force our children into threatening situations with homosexual predators and recruiters to satisfy you and your sense of morality.

Religion does not equal racial differences either, but are afforded equal protection.
Homosexuality is more than behavior. You can be homosexual without ever acting on it.

No, the Scouts have policies to prevent adults from being alone with children at any time. That should be sufficient.
Also, the non-discrimination extends to the scouts as well. This isn’t just about the leaders.
The Philadelphia chapter of the scouts doesn’t even agree with the national organization... they WOULD allow gay scouts/scoutmasters if allowed. That’s what is really sad about this situation... the Philly scouts are caught in the middle.
My bad, BSA would have to be the one to revoke an Eagle Award, not NESA.

Unfortunately, this has been shown in previous incidents to be insufficient and the BSA has been sued because of it. Therefore, the BSA took the extreme measure to protect the boys and subsequently the BSA.

Then the Philly Scouts should start their own organization if they can't abide by the Scout Law, Oath and Charter rules. The BSA does not "own" the Troops, the Organization that is supporting the Troop through Chartering "owns" the Troop. If they agree with the homos in Philadelphia, then they can sever their ties with BSA and go down that path if they so choose, but they don't need to drag the BSA down that path.

It’s not just the masters... it’s the boys as well. There ARE gay scouts.
Not all gays are pedophiles. There should be protective mechanisms in place for safety, and gays should be allowed to be in the boy scouts IF taxpayers foot part of the bill.

Sexual predators, no matter what their leanings, go where the opportunities are. There is a reason that known predators are not allowed within 500 feet of a gradeschool in some communities. I don’t see known lesbians trying to join the Boy Scouts.
The case you need to be referencing is Evans v. Berkley, a 2006 case where the City of Berkley withdrew a free berth in a city-owned marina from the Sea Scouts. The city argued that continuing to do so would violate an ordinance prohibiting support for organizations that discriminated, even legally. Lower courts had found that Berkley was within its rights. The California Supreme Court upheld the lower courts, and in October 2006 the U.S. Supreme Court refused to hear the case, letting the lower court rulings stand.
Long and short of it is that because of the Dale decision, the Boy Scouts can legally exclude whoever they want. But because of the Berkley decision, that doesn't mean that they are still entitled to the same support they used to receive.
Only those who haven't been identified. Following the Dale decision, the Boy Scouts applauded the Court's ruling that allowed them to set standards for leaders and membership. Homosexuals and atheists aren't welcome in either.

Like anything else, it depends on who you're dealing with. The organization is made up of members. Some follow the rules, some won't.
If I might modify your answer above a little bit.
Where BSA and its Chartered units draw the line is in selecting leaders. A typical adult Scouter participating in a troop or committee is not asked for a test oath or quizzed about issues like homosexuality.
Likewise, ten year old boys when preparing to join aren't asked for "sexual orientation" because rightly children and sdolescents are thought not to form such things in that age group.
In fact, I imagine that a healthy thing would be to say that such is not a decision, but instead what we would call in politics a "push poll". Asking presupposes that individuals are supposed to "make a selection" at some point. Instead, the selection is made at large for a two sex species and disorder (or whatever term people want to use) allows patterning in other manners in a small minority.
Scouts uses a program of "Two Deep Leadership" so that adult scouters are always at least two in number in dealing with scouts. The thought being that if one adult has deviencies, the presence of the other precludes that first adult from exercising such actions. This works well for any sort of wrong choice that an adult might involve youth in if left by themselves.
Note to folks in Philly: You all have bigger problems to deal with, don't you....
