Two Madison teens and a 24-year-old man were charged Thursday with disorderly conduct with a hate crime enchancer after they allegedly taunted and threatened an openly gay man and his two friends Oct. 31 in the Allied Drive area.
According to a criminal complaint, Vincent P. Odom, 24, Riccardo C. Simms, 19, and Milton L. Moore, 17, confronted an Allied Drive man and two of his friends around 11 p.m. at the man's home.
The complaint said the man told police he and his friends were walking to their car to leave for the evening when a man, later identified in the complaint to be Simms, came out of the window of 2222 Allied Drive and sprayed a fire extinguisher at them.
The man told police that after that, Simms, accompanied by two other men, later identified as Odom and Moore, began to chase the three, who are all openly gay. The man told police that Odom yelled anti-gay slurs and that the others threatened to kill him.
He also told police that Odom struck him in the back with a bat while he was trying to run back to his residence. When he made it inside, Odom allegedly smashed the glass door in the entryway, causing shards of glass to cut the man's chin.
According to the complaint, Odom, Simms and Moore continued to chase the man into the common area of the building, but he ran up to his apartment.
The complaint charges Odom, Simms and Moore with disorderly conduct with a hate crime enhancer, which carries a maximum fine of $10,000 and one year in jail. Odom is also charged with criminal damage to property with a hate crime enhancer, which carries a maximum fine of $10,000 and two years in prison.

They definitely should be charged but hate crime is probably not the right charge. Assult, stupidity, idiots, whatever but not hate crime.
