Romney Eyeing End to Birthright Citizenship

ABC News' Teddy Davis Reports: Republican presidential hopeful Mitt Romney backs an end to the policy known as chain migration but he has not yet reached a conclusion on the more controversial question of whether the United States should end birthright citizenship for children born in the United States to illegal immigrants.

"On the birthright citizenship issue, we're still looking at it," Romney adviser Eric Fehrnstrom told ABC News.

At present, all babies born in the United States -- except those born to enemy aliens in wartime or the children of foreign diplomats -- enjoy American citizenship under the Supreme Court's long-standing interpretation of the 14th Amendment. The amendment provides: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

While most constitutional scholars think ending birthright citizenship would require a constitutional amendment, the opposite viewpoint has credibility in conservative legal circles.

While most constitutional scholars think ending birthright citizenship would require a constitutional amendment, the opposite viewpoint has credibility in conservative legal circles.

The key here is the phrase “subject to the jurisdiction thereof”. Illegals are here illegally and not subject to the jurisdiction (court system) except to be deported.

Interesting! Without Birthright citizenship, Romney’s own father would have been a Mexican citizen.

Absolutely! I have a question if anyone can answer. The stories about Canadians coming over here to have babies because their health care system can’t handle them. Are those babies legal in the U.S.of A.?

Not sure what legal babies mean. Anyway, they are automatically US citizen if they are born here.

No birthright citizenship to illegals. However I fully support birthright citizenship of children of legal spouses.

Check the date and think who is adopting whose position. Romney comment was in July. Last time we had an amnesty bill, Romney placed TV ads opposing it.

No, the opposite viewpoint has credibility among a very small number of so-called conservatives. Most conservatives understand the plain language of the 14th Amendment.

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.

Well, it seems to me that everyone physically present is subject to the court’s jurisdiction unless they have diplomatic immunity; otherwise it would not be possible to charge them if they commit a crime.

BTW I do sympathize as our country also has birthright citizenship.

Nice to know that they Now agree with Duncan Hunter, who was on this Years ago. I didn't see anything in Fred's plan about anchor babies, did I miss it?
