Pizza delivery driver kills attacker in Roswell

ROSWELL, N.M. (AP) - Police say a pizza delivery driver in Roswell apparently acted in self-defense in the fatal shooting of a man accused of attacking him. The driver, Dustin Eoff, says he was jumped by three men and beaten with a tire iron as he was getting out of his car to deliver a pizza at a Roswell apartment complex.

Police say 25-year-old Jay Brito was shot to death during the struggle.

Police say Eoff is not facing any charges because the gun was fired in self-defense.

Holley explained that in the state of New Mexico a person can carry a concealed firearm in his vehicle and that if Eoff had not been on probation, there would have been no charges against him.

Well, in this particular case I hope they go easy on him as he could have easily lost his life using a pizza box against a tire iron and a knife.

I used to deliver pizzas and most of those pizza delivery companies have a policy against carrying weapons on your person or in your car. But it seems like pizza delivery guys are getting attacked more and more often.

Not necessarily, they may use common sense in this instance.

I believe that everyone has the right to self-defense, even criminals, it is what you do with something that should indicate whether or not a crime has been committed.

I always told my kids in school that if they are attacked to eliminate the physical threat to them. The school authorities told me that was wrong. I also told my kids that they should back away if at all possible.

The article on Dustin Eoff did not have much information on his health or anything else following the matter.
He lost a good piece of his ear and is in alot of pain he will have plastic surgery on it in a week or two after the swelling goes down. Dustin is not a mean guy shooting someone is the last thing he wanted to do but he was fighting for his life.
