Judge declares mistrial in Holy Land Foundation case

The Holy Land Foundation terrorism-financing trial ended in a mistrial Monday after the jurors deadlocked on most of the counts. One of five defendants was acquitted of all but one charge against him.

Mohammad El-Mezain, the Holy Land's original chairman and endowments director — was acquitted on most of the counts by a unanimous jury. The mistrial will not affect his acquittals, but he could still face prosecution on a charge of conspiracy to provide material support to terrorism.

A government prosecutor said the Justice Department will retry the case on the charges where the jury reached no verdict.

Earlier in the day, the jury forewoman told the judge that Mufid Abdulqader, a top Holy Land fundraiser and former Dallas public works supervisor, had been found not guilty on all counts. Abdulrahman Odeh, the foundation’s New Jersey representative, was also acquitted on most of the charges. She also said the jury was unable to reach a decision on all the other counts.

When polled, some jurors told the judge that they did not agree with the verdicts on Mr. El-Mezain and Mr. Odeh.

“Your verdict must be unanimous and it’s apparent to me from the answers of three members of the jury in respect to my question that the verdicts that I read earlier do not represent the unanimous view of the jury,”

It’s apparent to me that those three were bleeding heart libs.

I think the problem is these Islamist always have unwritten rules of custom, we all know they are giving money to terrorism and so do they. However all their so called charities are well written by western lawyers. It is clear a Muslim can lie and smile at the same time in order to promote jihad against the West. Look at how well they play the poor racism card. They are more cunning than we are right now to go after them. I am afraid it will take a second 911 to finally wake the sleeping giant, I can only pray it is not too late.

Absolutely.
Earlier this year I did happen to get the book “Alms of Jihad”
from the local library.
It was an extensively foot-noted/referenced book...almost a scholarly
treatise.
But Islamic money/power is sufficient to get Westerners to shut their
mouths and “burn” (withdraw) the truth.

Facing the mere threat of a lawsuit from Saudi billionaire Khalid bin
Mahfouz, Cambridge University Press agreed to pulp all the unsold
copies of “Alms of Jihad: Charity and Terrorism in the Islamic World,”
issue a public apology to Mahfouz and pay his legal expenses and
substantial undisclosed damages.

I think that you’ve got this backward. It was the forewoman who tried to screw things up when the three jurors called her on it.

It's really not clear what happened. It looks like these three are the only ones who stood in the way of more wide-spread acquittals. I don't think we know much more than that. This one is a real head-scratcher.

It's a shame the jury couldn't reach a verdict in such an important, time-consuming and expensive trial. I hope the next trial goes better.

At a guess, the bad guys got the best justice money could buy. Or some members of the jury (possibly the pricipal juror) had a case of BDS.

What a bizarre conclusion to this trial. Is the forewoman a Muslim, a Muslim sympathizer, or just a leftie afflicted with hatred of her country?

Yeah, I agree those guesses are a good possibility. I can think of other good possibilities as well.

Overall, I'm not hostile to out trial-by-jury system -- even though I know it has advantages and disadvantages, especially in complex and politically-charged cases.

I hope we'll find more over the coming days and weeks -- I know the prosecutors will be looking at this in great detail as they plan strategy for the next trial.
