Theyre taking the scofflaws to court. This time, its not just a meat-packing plant or a construction contractor, or some small business hiring illegal aliens. This time, its the whole blooming state of Illinois, which has one of the worst records of looking the other way when illegals take jobs.
Taking the amnesty approach to a new low, Illinois passed a law banning employers from participating in the Basic Pilot Program (aka E-Verify), the successful federal system used to track down phony Social Security numbers and thus detect illegal workers.
Other states, such as Arizona, are mandating that employers use this system. Going the other way is Illinois, the so-called Land of Lincoln that henceforth shall be called the Land of Winkin winking at illegal workers, that is.
In announcing the lawsuit, Chertoff said, Well, it's very simple. When Congress passes a law, everybody has to abide by it, and that includes the states. And the states don't get a veto over which federal laws they want to have obeyed or not obeyed. In this case, the state's actually gone so far as to prevent people from obeying the law or taking advantage of an opportunity Congress has provided to check your workers. And we just can't allow that to continue.

Private persons and entities may initiate civil suits to obtain injunctions and treble damages against enterprises that conspire to or actually violate federal alien smuggling, harboring, or document fraud statutes, under the Racketeer-Influenced and Corrupt Organizations (RICO). The pattern of racketeering activity is defined as commission of two or more of the listed crimes. A RICO enterprise can be any individual legal entity, or a group of individuals who are not a legal entity but are associated in fact, and can include nonprofit associations.
Heres what Ive been pushing: its time to file Racketeering, Influencing, and Corrupt Organizations (RICO) lawsuits.
RICO lawyers could turn it around in a few years and MAKE MONEY at the same time. Im surprised they havent done it already.
In the absence of enforcement, we can get the word out in the meantime that there is money to be made in filing RICO lawsuits against employers who hire illegal aliens.
Employers would have no trouble shutting down the border if they could get sued by someone under the RICO statutes for hiring these people in the first place. The next time an illegal alien kills someone in a drunk driving accident or somesuch thing, Im going to point out that the victims family might be able to seek compensation from the employer under these statutes in the hopes that it would catch on. If this did catch on, would see such a swift backlash against illegal immigration that no employer would go near these people and theyll all simply want to go back home.

This is nothing but a lot of hype by Chertoff and the Administration in an attempt to provoke the pro amnesty and the MSM crowd into more demonstrations against this type of tactic.
It is anti illegal alien and will get big air time on TV ... Oh don't forget the Senate and House ... Nothing to get any hopes up for some actual enforcement!

The second that law was passed, and Illinois thumbed it’s nose at Federal Law, all Federal Funding should have been immediately withdrawn.
I've done some research on this and it seems that lawyers agree with the concept. The only glitch is the requirement for two predicate offenses to file a RICO suit, but this seems minor IMO.
So where is the conservative ACLU that will help to handle these cases? Seems like an opportunity for a group like the Thomas More Law Center.
I think you are correct on the objective but wrong on the tactics. Once of the reasons the amnesty bill met such opposition was nobody believed the Fed Govt. had any intention of implementing any enforcement efforts. Bush is now trying to convince the right that he is "solid" on enforcement before they make another run at it.

The attorney that I met at an illegal immigration conference that is pursuing RICO suits against employers of illegal aliens is Howard Foster. Maybe this is an idea you might want to discuss with him.

Chertoff is a perfect puppet. Completely void of brains and obeys without question.
Last year(?) Chertoffland couldn’t deport 20 million.
Six months ago(?) the fence wasn’t feasible.
Last month started round up by the thousands.
Now’s he’s suing States.
Lately the guys career is a post-it note written in haste.
A civil lawsuit is nice, but criminal charges and jail time would be better.
IMHO it would probably be much more effective and less expensive to cut off all federal funds to the state.

My thoughts exactly. Your statement also shows the amount of credibility this administration has with many of it’s own party.
