Of course I am not saying it is acceptable.

Please stick to the topic. The issue is whether this is an actual Federal law with criminal penalties, or not. As far as I can tell, it is not. If the person who flew the Mexican flag above the US flag was arrested by an FBI agent, the prosecutor would have no case.

It may be in bad taste but it is not an enforceable law as there are no penalties attached.

One does not preclude the other. It is absolutely wrong to fly another nation's flag above the Stars and Stripes. However, it was still illegal for Brousard to vandalize the owners flag pole and steal his flag. Note that Brousard did this in broad daylight with full disclosure of his idenity, and his intention. That's civil disobedience and civil disobedience done right.

It's not OK. It annoys me. That doesn't make it a federal crime.
