DENVER, September 26, 2007 (LifeSiteNews.com) - A federal appeals court has issued a significant ruling saying that an employer's concern over the use of restrooms by "transsexual" employees is legitimate, according to Alliance Defense Fund Senior Legal Counsel Brian Raum. Raum explained further that the court ruled that "transsexuals" do not qualify as a protected class under Title VII.
"The court delivered a significant legal punch to political special interest groups who are demanding that persons with Gender Identity Disorder be treated as though they were members of the opposite sex. The court correctly ruled that employers have a valid concern regarding their employees' proper use of public restrooms," said Raum.
The U.S. Court of Appeals for the 10th Circuit ruled Thursday that the Utah Transit Authority had a legitimate concern over a male employee's restroom usage. Michael Etsitty, a male employee, had begun taking female hormone therapy and wearing women's jewelry and makeup but still had male sex organs. UTA had liability concerns regarding the man's use of women's bathrooms.

New restroom signs needed: Men / Women / Things

I worked at a company that employed a transsexual for a while many years ago. It was VERY uncomfortable when she/he came into the women’s room. I would peek out the door of the stall to make sure he/she wasn’t trying to look in at me. Creepy.
Please excuse my ignorance, what is a pagina?
Why wasn’t the case made in the 9th where it would have been a slam dunk?
Penis/vagina
The guys don't want them in their restroom either.
I can only imagine. At least women use stalls and have some privacy.
This is very interesting to me because I work as a contractor (having had my last THREE jobs outsourced) at a company called NCR in Dayton Ohio.
About a month ago we received an email from our manager stating exactly this same thing. ‘Jerry’ was going to be dressing and behaving as ‘Jenny’ and thus will be using the women’s restrooms.
None of the women I work with are thrilled. I personally go to another floor when nature calls. Several women who are employees of NCR rather than contractors, have asked to be able to work from their homes rather than deal with a hairy man dressed in women’s clothes in the ladies room.
Being a contractor subject to renewal every 6 months, I haven’t said anything about the situation but I think about the legalities often, and this article really hit home.
I think that NCR is opening itself up to a serious lawsuit if it continues along this road. It is my understanding that there are at least 3 other persons in the building also in the throes of ‘sex changing’. Evidently NCR proudly supports and celebrates diversity, but at what expense, I wonder?
The really interesting part is that Jerry/Jenny is also a contractor, and probably will be renewed forever if NCR is afraid of being sued by him/her. The really REALLY curious part, to me at least, is that his/her significant other is a LESBIAN!!!
So, I guess this means that Jerry/Jenny is working up to getting a sex change in order to become a lesbian? Darnedest thing I ever heard of.
Jerry/Jenny is probably in his early 50s or so, with nearly grown children. I imagine they must be proud.
There is more to this story, including a touching email sent by Jerry/Jenny (which could not be forwarded, I don;t how he/she protected the email in that way but I could not forward it) sent to all of us ‘to answer any questions we might have about the issue’. The email discusses how he/she was NOT a pervert or a sexual deviant (!) and on and on, straight out of the gay handbook.
I know exactly what you mean! And the worst thing is that today, this kind of thing is celebrated as ‘diversity’ and if you don’t agree with it, you must be some kind of a bigot.
OK,I think I’m gonna be sick now...
It’s OK to get sick. Farmers don’t have any animals like this growing in the barnyard. If/when one might be found, you just shoot it.
Utah isn’t in the 9th, fortunately.
Coming soon: if DNA evidence is one's only clue in a crime, transsexuals will escape apprehension more easily. They won't show up as their genetic sex in a database search, since it will all be revised to concur with their pretend sex.
