What if they had called her a “B**ch” or some some variation of the “F” word or maybe an “a**hole.”

Would that be as much hate as a racial word?

Once you tack on that extra “hate crime” charge for using words, the question is which other words should be included.

Its a slippery slope to banning words from being used.

First Amendment please.

A man in Lancaster, PA actually got fined 500 dollars for using the “N” word. I hear people using the “F” word in public all the time. Which word is more offensive and should merit the punishment?

Right now the “N” word has the priority but please don’t say the “F’ word should be punished with a fine because then we are going down the slippery slope of losing free speech.

As bad as any crime of battery is, a prosecution under “hate crime” laws or penalty enhancements is prosecuting people for what they think.

Freedom and civil rights means being able to think anything I want about any person, foolishly or not, up to the point it physically affects that other person.

Stupidity should not be a crime.

The use of racial slurs indicates this attack was BECAUSE the girl was black. And WHY they attacked her should make absolutely no difference at all. Would the heinousness of the crime have been any less severe if they had done all this to her because she was wearing a red t-shirt instead of a blue t-shirt? Would it have been any less heinous if they had attacked her because the malt liquor they were drinking was tainted with urine from their goats when they brewed it? It doesn't matter AT ALL why they attacked her. The crimes with which they are charged and the punishment if they are convicted should be based entirely on the nature of the crime -- NOT the motivation behind it.

Those are not racial slurs, just common filth.

Read history. Please. The First Amendment gave us the right to speak out against government without fear of reprisal. It has nothing to do with a filthy mouth or racial slurs.

I disagree. Normally I dislike the term "hate crime" because it's not used in reverse cases. And it is used as a thought crime term. In this case, it appears to be the REASON for the attack.

That doesn't matter. The attack is heinous regardless of the reason for it. Are you suggesting that because her race was the reason for the attack that it should be prosecuted as a higher level felony than an idential attack that occurred because the perps were just horny to inflict some pain on someone and they picked a victim of their own race? If you advocate tacking on "hate crime" status to this crime rather than simply punishing it for the brutal crime that it is, then you are suggesting EXACTLY that.

Legalistic treatment of people’s words will be used to silence you and anyone else that says the wrong thing if you allow “hate crime” laws to exist.

The intention of the liberals who created them is
to eventually include “sexual orientation” especially and who knows what else.

Then reading the Bible out loud becomes “hate speech” because of those passages about homosexuality.

The attack is heinous

Yes it is. And I'd love to see the 6 that tortured and murdered the white couple get nailed under the "hate crime" tag.

So racial, religious, etc., motivation for a crime should definitely be considered during sentencing, and the sentencing guidelines should reflect increased penalties where such motivation has been established.

OK, I can live with that.

So if somebody beat up your kid just because he was in a mood to beat somebody up, and then went out and beat up another kid because that kid was a different race, you would have no problem with the second beating being treated as a more serious crime even if your kid got the worse beating?

No, it would not bother me that the perp got special attention for multiple crimes. What would bother me would be if my kid's case was considered a "boys will be boys" incident while the other attack was prosecuted due to the race of the victim.

Hate Crime Statutes are Crap

As are RICO Statutes which like Hate Crime Statues have a veil of legitimacy which is used to hide their inherent injustice.

Both are perversions of the law, enforced in a Political and Ideological based manner.

The Antitheses of Justice.

So if your the perp that beat up your kid was charged with misdemeanor assault, while the perp that beat up a minority or other protected class kid is charged with felony hate crime assault for an equivalent or even less severe beating, you would object? In that case you should have a serious problem with invoking "hate crimes".

“What happened in Knoxville?”

The first of the year a young white college couple was kidnapped by a group of black thugs. They raped the young man, castrated him when he was still alive, and later killed him. They held the young lady for another week, they sexually abused her, cut off her breast when she was still alive, forced her to drink drain cleaner to get rid of any DNA evidence, and later hacked up her body and disposed of it in separate trash bags. The prosecutor in this case said it was not a hate crime since the black suspects were friends with some Caucasians.
