Judge Puts Hold on White House Plan to Warn Employers About Hiring Illegals

A federal judge has put a halt on a planned White House crackdown on employers who hire illegal immigrants while she considers a lawsuit filed by the AFL-CIO claiming the move would harm citizens and those working in the U.S. legally, the Washington Post reported on Saturday.

The ruling, issued by U.S. District Judge Maxine M. Chesney, bars the Department of Homeland Security from sending mail notices to 140,000 employers about suspect Social Security numbers.

The AFL-CIO and the American Civil Liberties Union say that DHS is going beyond its mandate to enforce immigration laws and is misusing the Social Security Administration’s database, according to the report.

"We're disappointed by the delay and expect to prevail once the court has the benefit of full briefing and argument," DHS spokeswoman Laura Keehner said.

She added that Homeland Security will continue other immigration enforcement programs.

The ruling allows Judge Chesney to review the lawsuit before issuing a decision on the DHS plan. A hearing on the case has been set for Oct. 1.

The judge is a Toon nominee.

Quelle suprise.

Note to the GOP: There's a great campaign ad here vis-a-vis the judiciary. That is if the party grows a pair.

I had a Hispanic employee who had her identity stolen by an illegal; it took her 5 YEARS to get the IRS off her back over the W-2s that showed up from the illegal. I wonder if the ACLU would sue the IRS over the persecution of Hispanic American citizens that results from identity theft by illegals?

Can you think of any other crime where the criminal (employer hiring illegal aliens) gets a WARNING first? Shall we warn bank robbers on their way out the door with the loot to cease and desist?
And to top that insanity, a judge blocks the warning to the criminal?

I do not believe the ruling holds any weight against the President ordering existing laws to be actively enforced.

Not quite. But by using the logic behind illegal aliens being allowed to roam freely once across the border, a bank robber would be in the clear once he escapes the law for a while.

IMBEDS are so much more than reporters following war action ...

They're in the DMV, Post office, Police force(s), and a bunch of etcetera's.

Call me confused, but I don’t see whether it is within her authority to decide whether or not it “harms” other workers. Her job is just to decide whether it conforms to law, and leave the lawmaking to the lawmakers.
She needs to be removed.

Yeah. I look forward to the ACLU opposing the taxpayer funded Muslim prayer footbaths in Michigan. Clearly a violation of the first amendment as the ACLU has pointed out many times: government may not fund religion.

But WAIT! The ACLU is FOR this entanglement! Why is that do you suppose?

Misusing the Social Security system?
I love it!

I remember my first Social Security card prominently showing the following:

"Not to be used for Identification Purposes"
That is no longer true.

Sometimes I love unintended consequences.

For many decades now, all citizens and legal residents have been required to provide this "number" for everything from mortgages to the income tax, to employers, lenders, credit services and even any random service which demands it.

Incidentally, how do these new laws harm citizens and "those working in the US legaly?" exactly???

Remember ... most pols started out as, and are stil de-facto lawyers.

x42 was (is?) a Constitutional "scholar" of the Marxist degree and as such, studied, not to learn about and to love, cherish and protect our Constitution, but to see, learn, devise and develope ways around and through the Constitution.

And as a Rhodes "scholar", it's intent (it, meaning x42) .. is to overthrow the sovereignty of the USA and bring it into a global state.

THAT is the enemy within.

I don't care that much about the "issues" in this upcoming election as much as I care about strict Constitutionalists.

One more (and wouldn't it be glorious to get two ?) strict Constitutionalists on the SCOTUS would save our nation for another hundred years.

Don't forget, our framers thought in terms of posterity, not so much with a view to their immediate lives.
