Judge stays ruling that tossed Iowa's gay marriage ban

DES MOINES, Iowa (AP) - The Iowa judge who threw out Iowa's ban on gay marriage says he has formally issued a stay of his ruling.
The gap between yesterday's ruling and today's stay gave two men a narrow window of opportunity be married outside a minister's home in the state's first legal same-sex wedding.
The judge put his ruling on hold about two hours later.
About 20 gay couples had applied for marriage licenses when the Polk County Recorder announced that she had been instructed to stop accepting the applications.
An attorney in Polk County says the county has filed a notice of appeal. He says the Iowa Supreme Court can refer the case to the Iowa Court of Appeals, consider the matter itself or decide not to hear the case.
Well, it looks like its time to find out who this idiot judge is, how he got to his bench position, and from which political persuasion does he come from.
Sounds like this toe-tapper was FOR homosexual marriage before he was AGAINST it. Must be a Kerry fan.

I’d just like to have it in writing so I can add it to my collection as I don’t have an Iowa one yet.
People need to look carefuly if there’s any relation between this judge and the the couple who took advantage during the two-hour window.
He stayed his own ruling? What is he a schizophrenic?

Not really; it’s not that unusual. He wanted to make the ruling, but he didn’t want a media circus around thousands of gays camping outside the courthouse for their chance to get married. I.e., he thinks that the Iowa Supreme Court will affirm his decision; he’s not doing it as a political stunt like some San Francisco mayor who shall remain nameless.
As for the specific details of the ruling itself, so far, I’ve only been able to find them on pro-gay sites :P This is the best I’ve found so far:

If anyone finds the details of the ruling — or even better, the exact wording of the ruling — from a more impartial site, please let me know. From what it sounds like, Polk County put up an incompetent defense, not even attempting to counter some of the plaintiffs’ arguments. The judge then ruled out all evidence that wasn’t peer-reviewed science, which blocked Polk’s religious testomony (plus a few other arguments from both sides). The plaintiffs flooded the court with studies that backed up their side of the argument, while Polk didn’t. The end result was that the factual summary ended up looking like an amicus curae submitted by a gay-rights organization :P
Judging from what I’ve seen thusfar, I blame it all on an incompetent defense by Polk County and a judge too obsessed with peer-reviewed papers to listen to common sense.

Thank you for a very good answer. It just sounded very odd on it’s face but your explanation is quite understandable. Too bad about the incompetent defense.
What amazes me is that the marriage laws are challenged based on civil rights, equal rights, and other such legal issues. Having said that, it’s important to note that marriage laws treat everyone equally. Namely, that ANY eligible man can marry ANY eligible woman. ANY eligible woman can marry ANY eligible man.
Because any eligible woman can marry any eligible man, there is nobody who is being discriminated against under current marriage laws.
This should be an important legal point of order, because everyone is treated the same under our marriage laws!
If everyone is treated equally under our marriage laws, then there is no violation of anyone’s civil rights.
I’ve been baffled from the beginning how these liberal judges fail to grasp this simple legal concept that the current laws treat everyone equally already. Those who want to get married under the current laws will, and those who don’t, won’t. Homosexuals want to change the definition of marriage, which is an entirely different issue.
I think this same-sex marriage freight train through the courts erodes respect for the legal process and laws in general. It sends a very strong message that judges decide what the law should be, not what the law is.
Stay tuned. This issue is going to be in the courts for years to come.

All District Court Judges in Iowa are state employees, appointed by the governor. Hanson was appointed by Democrat Tom Vilsack in 2003.
