This is exactly the type of thing that is discussed a few times in “The Federalist Papers”.
That the States would FOREVER retain their sovereignty, and if the Feds fell asleep at the wheel, the States could do it.
And nothing here that the states are doing violates federal law. 8 USC 1320?? is the law that talks about harboring aliens, aiding and abetting their illegal entrance, etc.
As far as federal powers in this area, it amounts to one:
To Establish UNIFORM RULES OF NATURALIZATION.
Not to administer.
To establish.

Madison County Commissioners will take up a proposal by Commissioner Mo Brooks today that would require contractors doing business with the county to sign a statement saying they are not employing illegal immigrants. Contractors would also have to report any illegals they find during employment background checks.
