A federal judge on Wednesday kept alive a lawsuit accusing Georgia gun dealers of illegally selling firearms that end up being used in crimes in New York City.
In a 99-page ruling, U.S. District Judge Jack Weinstein in Brooklyn said he found ample evidence the gun dealers "have been responsible for the funneling into New York of large quantities of handguns used by local criminals to terrorize significant portions of the city's population."
The judge rejected motions filed by a number of gun shops, including Adventure Outdoors in Smyrna, that sought to dismiss the lawsuit filed by the city of New York. Adventure Outdoors and other gun stores in Ohio, Virginia and South Carolina argued they couldn't be sued in federal court in New York.

This is a lawsuit against the guns, not the criminals who used them and through some strange reasoning the dealer where they were sold can be held responsible for their subsequent resell or ultimate use under the arguments in the suit.
What NY is apparently after is a trial on home ground where a ruling that specifically disallows any dealer from selling a gun that could through whatever means end up making its way to NY and causing harm or injury.
Since a long and arduous trip through the courts was decided that the gun manufacturers could not be sued, after Congress stepped in, notorious dealers (those whose sales appeared frequently as having been used in the commission of a crime) are now being made to pay for crimes of omission and a lack of intent through ignorance is to be shown as failing to exercise due diligence.
This ruling merely says that, in this judges reasoning, the law does not disallow the interstate nature of the suit.
If this ploy fails, the lawyers will come up with another way to limit or ban the sale of guns and, ultimately the possession of guns.

Apparently one has countersued NYC, for $400mm.
But yeah, Bloomie will use NY Taxpayers’ money to try to outspend them on legal fees until they cry uncle.
