The same sort of "Legislation through the Courts" and "Judicial Activism" that is decried so forcefully here when it is practiced by the Left (Roe v Wade or Kelo v City of New London, are two prominant examples) ....
but it's ok if the Bench legislates YOUR morality???

If abortionists are permitted to sue pro-lifers who peacefully picket outside of abortion clinics, then citizens who find pornography offensive should be allowed to sue the purveyors of smut.
