'Hate crimes' charge doesn't require 'hate'

Judge: Victim's homosexuality enough to seek higher penalty.

A judge in New York has ruled evidence of "hatred" is unnecessary for a prosecutor to pursue a "hate crimes" case against three men arrested for the death of a homosexual man.

The written ruling came from Judge Jill Konviser of the State Supreme Court in Brooklyn, and concluded prosecutors only need to show that the man, who was beaten and then hit by a vehicle in a robbery attempt, was picked because of his sexual orientation, according to a report in the New York Times.

The judge said that is enough for prosecutors to seek enhanced penalties for the defendants, if convicted, under the state's Hate Crimes Act of 2000.

Let's see, now. In order to be guilty of a specifically named crime one does not have to commit that patticular crime, All that has to be present is that the victim happens to be one of the multitude of types of perverts, odd balls, races, cults (or any other screwball things the bleeding heart liberals can think of), that the particular law was written to protect. Even though the perpetrator couldn't care less what type of oddball the victim happens to be. Hell the perpetrator doesn't even have to know what or who the victim is.

Sounds like a test case to strike down the whole notion of "Hate Crimes" because of an equal protection argument. Clearly this sets up some folks as being "more special" than others and causes the law to apply differently based on the "group" membership arbitrarily attributed to the Defendant rather than the crime.

This creates the possibility of the "Gay" defense for this additional charge where the Defendant may feel compelled to claim to be "gay" to lessen the penalties they might incur.

I certainly do not support hate crimes legislation.

But I thought in this case the victim was chosen because of his sexual orientation and then hit with a car because of it.

If someone goes around deliberately hitting blacks or gays or anyone with cars they need to go away to prison for a long, long time.

This seems to be a case where WND chose a headline that does not match the facts.

You may want to read the article. He was hit with a car because he entered traffic running away from the robbers, not because he was homosexual. They chose him because he was an easy target.

Prosecutors said the three defendants, Anthony Fortunato, 21, Ilya Shurov, 21, and John Fox, 20, found Sandy through a homosexual online chat room. Court documents allege they picked him because "this was an easy way to rob someone."
