I don’t know if it is technically illegal but it seems one would want to know there was an underwater object nearby if one was running a boat along the surface. WOuldn’t it be a matter of traffic control like highways and airspace? Does it have a radio, a signaling device, a way for others to see it from the surface? I’d be surprised if some of that wasn’t part of the regulations for navigable waters.

It might be considered a Hazard to Navigation. Also, perhaps the cruise ship docks are considered restricted areas. There is not that much information in the article.

What exactly did they do that was illegal? They violated the 100 foot exclusion zone around the QE2. Plus a whole host of Coast Guard regulations I'd imagine. :)
