Democratic Sen. Charles E. Schumer said Friday that the Senate should not confirm another U.S. Supreme Court nominee under President Bush "except in extraordinary circumstances.”

"We should reverse the presumption of confirmation,” Schumer told the American Constitution Society convention in Washington, reported The Politico. "The Supreme Court is dangerously out of balance. We cannot afford to see Justice Stevens replaced by another Roberts, or Justice Ginsburg by another Alito.”...........................

That’s okay...let ginzberg or stevens retire....I like 5 to 3 conservative decisions....let Bush not send another one before he leaves office. They’ll be screaming for Bush to nominate some one just for “balance” but he can just hold back and let the 5 rule over the other 3. Even with 4/4 split decisions concerning the conservative rulings of lower courts; those rulings will be left standing.

So go ahead Shumy, cut off your nose to spite your face!

Methinks John Paul Stevens or Ruth Bader Ginsberg are on the verge of retiring.

Neither will retire without a Democrat in the White House to replace them...

“The new ‘conservative bloc’ is undermining the authority of the judiciary.” Breyer complained. “If this trend is allowed to continue unchecked, the Court’s ability to rule this country will be seriously compromised. We can only hope that the Democratically controlled Senate will prevent any of Bush’s further nominees from being approved.”

That's the most stunning comment I've read in a long time.

Supreme Court Justice Stephen G. Breyer, spoke with Specter earlier this month, telling him that the court term that ended in June was notable for rulings that reversed some long-standing decisions.

I do not believe Mr. Justice Breyer said any such thing.

This is what the 08 White House contest is ALL about. Not the W.O.T., Not the Economy, Not for ANYTHING else other than “Control Over” Supreme Court PERIOD. This was the route the Liberal’s have taken since 1947 Everson vs Board of Education, and the Legislation Passed through the Courts since then. We are truly on the razors edge. Fun Huh......:)

“the Court’s ability to rule this country”

We need a simple test of the knowledge of the Constitution to be filed with the campaign papers, made public.

This is shockingly ignorant for a senator.
