Check me if I am wrong but was it not the legislative branch that gave the Executive branch the right to pardons and sentence commutations.

No, it was the Constitutional Convention. The founding fathers did it.........for good reason......

It comes from the King... in the monarchy, His Majesty could see fit to extend mercy at his pleasure and it has always been the King's call alone as to whom to forgive. The Founders adopted this ancient practice and vested it in the President.
