The basic idea of the Constitution is that the government can't be trusted. The defense of this Executive Order, which ignores the 5th amendment will be that "well, whats the problem is they apply it to people who are helping the terrorists"? The question is, who decides who is helping terrorists? According to this EO, the executive, not the judicial branch, does.
In other words, don't worry about the Constitution, trust the government.
Sigh.

I was thinking more along the lines of the Kerry properties, the Kennedy compound, Harry Reid's land holdings, and Hillary Clinton's bank account...
That was just a joke, because I do actually believe in the protections provided by the Constitution.

wow. the president cannot suspend the 5th amendment. Time to get a new AG to advise the President. Gonzales seems to think that the Amendments were made to be tossed aside.

I wonder if this falls under the Unitary Executive Theory.
Specific Constitutional reference:
...make all Laws which shall be necessary and proper for carrying into Execution... all... Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof IE, the Executive branch is given power to make laws that are necessary for it to enforce other areas of the Constitution.
Not defending, just discussing..
