To force him to pay would be a monstrous injustice. He doesn't even have a relationship with the child and its acknowledged he's NOT the father. So he ought to owe NO child support whatsoever. Zip, zero, zilch, nada.

Court precedents are clear...innocence is NO DEFENSE to Child Support charges. An allegation is all that matters. Charlie Chaplin PROVED that he was not the father via blood-type analysis, yet he was STILL help liable.

When I hear about cases like this I am always amazed more Judges don’t get murdered.
Every once in a while you hear about some guy who thinks the system has screwed him shooting up a courthouse but it’s not as common as you would think.

When I read this, I thought of the baby sitter watching a child color a picture, always yelling: "Stay inside the lines!" Bureaucrats don't have the mentality to interpret where the lines are. If fairness is to be found outside the etched-in-stone lines, you're screwed.

This happens all the time. Gil Garcetti, of California is a master of screwing guys into paying for kids that are not theirs, and they have never even met the mom or kid, they just had similar names and didn’t fight the court in a timely fashion.

Almost every divorced guy I knew was paying mandated child support.
Almost every divorced woman I knew was not receiving mandated child support.

When my sister was in law school, she read such a case to me from a book. It was twenty years ago. If you enter into an agreement to pay child support based on a belief that the child is yours, you have to pay even if it turns out you’re not the father. If it can be shown that the mother deliberately deceived you, that might make a difference but if both parties thought you were the dad you’re stuck.

Any order for child support for a child that he is not the father of is a travesty of justice...but hey...how long has it been since our legal system has actually put the just in JUSTice?

Of course this is ridiculous and a hideous display of legalized injustice.
The girl's mother evidently has said that Rodriguez should not be paying child support. She could--and should--return the money to him.
A man should NEVER be required to pay child support involuntarily for a child whom he did not father. In a case (and there have been many) in which a child's mother knowningly and fraudulently causes a man to think that he is the child's father and thus fraudulently extorts child support payments from him, the woman should be subject to civil suit--by the man, his wife, and his children--for recovery of all child support payments paid, with interest, and for punative damages.
That's a no-brainer--that is for anyone who values justice.
