Nine File Suit Against TB-Infected Man

MONTREAL (AP) - Nine people filed a $1.3 million lawsuit Thursday against the globe- trotting tuberculosis patient for possibly exposing them to the disease on a commercial flight from Prague to Montreal.

Montreal lawyer Anlac Nguyen filed the motion in Quebec Superior Court on behalf of seven Canadians and two natives of the Czech Republic. Eight were passengers on the flight with Andrew Speaker and the ninth is a brother and roommate of one of the passengers.

Speaker, a 31-year-old Atlanta personal injuries attorney, was in Europe when he learned tests showed he had an extremely drug-resistant strain of tuberculosis known as XDR-TB.

A car hits you crossing the street = big lawsuit.

The same car barely misses you, you get NOTHING, despite the momentary fear of God you experienced.

That’s just how it is. This lawsuit will go nowhere.

That analogy borders on the silly:
a passing car can't infect you with "hittedness," but a tubercular passenger can infect you with tuberculosis, and it's not impossible that some of those exposed to this self-center POS could yet develop the disease.

Certainly they have had to live with that fear - needlessly.

Wasn't Speaker told to turn himself into the Italian medical authorities by the CDC? Didn't he act on his own, with disregard to the health of those who would share the cabin recirculated air with him, by choosing to fly to Canada? Weren't his flights booked, cars rented, etc., etc., to circumvent the directive of the CDC? Were any of the plaintiffs subjected to quarantine (loss of wages, freedom, etc.) due to their unintentional contact with Speaker?

I agree w/you...it was all about ‘him’...’his’ honeymoon trip to Greece and Italy...never mind about the ‘little people’ who might get infected. If you have read the whole back story, I think there is much, much more to this...his father-in-law is a TB researcher...hmmmm.

Dude, where ever you are, step into the light of reality.

What you say may seem "right", but the fact is....

Pain....suffering....mental anguish....etc.

Blood in the water, sharks, etc.

I flew on that very same jet 1 week later, etc.

This has lawsuit written ALL over it.

Are you kidding me, in this day and age? They will sue this ignorant toad, the airline, the air traffic controllers, the ticket clerk AND the baggage handlers.

And I think I'll sue YOU just for saying this has no merit!

Criminal charges, sure.... But unless a near-miss is horrendously traumatic, the chances of suing successfully are nil.

If it’s bad enough, you could certainly call witnesses to testify, and show that you’ve been in therapy as a result... especially if you are (or were) a minor at the time.

I doubt any of these people have been in therapy over a TB scare.

Just thought of something else...who is paying for these other passengers to be tested for TB? Their own health care carriers? Doesnt seem fair. Would they (the other passengers) be taking TB tests if they were not exposed to Speaker? So if nothing else...they have incurred medical costs; lost wages; expenses related to getting to the Dr/clinic for testing...plus the duress of 'waiting' for th results, worrying if they inadvertently passed the TB onto their loved ones...WHY DIDN'T I GO TO LAW SCHOOL?

TB patient tests negative, but he is 'culture-positive'

Doctors at National Jewish Medical and Research Center in Denver, where Speaker is being treated, said two tests of sputum, mucus coughed up from deep in his lungs, were negative for TB bacteria. If a third test is negative, it would mean he is "relatively non-contagious," spokesman William Alstetter says
