Because the liberals on the Supreme Court decided to tell the President how to conduct a war, violating his Consitutional Powers. But on the other hand, since we are at war but have no official declaration of war, are we officially at war? And id we did have a declaration of war, who would we declare war against?

We need the equivalent of a series of 18th Century British Admiralty Courts which dealt with pirates, to handel cases involving terrorists in which standard U.S. court proceedings and standard rights of the accused are not respected and which do not fall under the jurisdiction of the Supreme COurt.

Since there was no peace treaty with Iraq after we kicked them out of Kuwait just a cease fire, plus twelve years of UN resolutions because Saddam did not live up to the cease-fire agreement, hostilities resumed .... so it’s still the first Gulf War ... IMHO ....

Even THEN, we had no declaration of war.

That concpet seems to have gone oout the window and ignoring that formality makes it easier for the political opposition and anti-war groups to undermine our military efforts.

Bush had enough people supporting him after the 9-11 to have gotten a formal declaration of war against any terror supporting state, which would have been valid against Iraq, Iran, Afghanistan or Syria - or even North Korea.

I think the reason he didn’t do it was because war is bad for international business.

Well kinda we did - Kuwait asked for our help to remove Iraq from its country and the UN sanctioned our actions .... and since Iraq is a member and all that ..... just like Korea ... it was a UN deal ....

WIthout a formal declaration of war, we can’t lock up traitors who protest under the false premise of “Freedom of
Speech”

Understand ... but wasn’t the first Iraq war UN sanctioned? ... we got the Ok to move on Iraq to get them out of Kuwait??

Yes. But we shouldn’t have committed our troops without a formal declaration of war - that’s why we lost in Viet Nam. Without that document, we couldn’t lock up the anti-war protestors who lost the war at home - the same way they are doing it again.

But wasn't Korea the same thing????? plus there were demonstrators during WWII ... ‘course they either got beat up or incarcerated ..

Good point.

Korea WAS the same thing.

The FIRST “undeclared war” in recent history, the first recent one we didn’t win and a war run by a Democrat President.

Grandad flew in Korea ...P51D’s .... I think basically it was a draw .... China pulled out at the end and left NK to fend for itself ... they saw they couldn’t win alone ....
