Ohio Teacher Doesn't Have to Pay Union Dues Over Abortion Stance

Columbus, OH (LifeNews.com) -- An Ohio teacher is delighted following a federal district court ruling that requiring her to pay dues to the National Education Association is a violation of her First Amendment Rights. She sued to stop being forced to fund the organization because her money would be used to promote abortion.

The Ohio affiliate of the national group told Carol Katter she could only be exempt from paying union dues if she changed religions.

Katter, a mathematics and language arts instructor in the St. Mary’s district, had requested and exemption after learning her dues would promote abortion.

"I know where NEA money goes, and I knew I never wanted to be part of that," she told CNS News at the time.

Katter indicated she was told her dues could go to a charity but OEA officials eventually told her they couldn't disseminate her dues elsewhere because she couldn't prove that her Catholic faith went against her membership in the union.

She filed a lawsuit in the U.S. District Court in Columbus in January over an Ohio law that prevents her from diverting her union dues somewhere else. The law only allows members of the Seventh-Day Adventist and Mennonite churches, which have historic anti-union religious views, to object to paying the dues.

On Friday, U.S. District Court Judge Gregory Frost struck down the law as a violation of the First Amendment.

Forst also ruled that the State Employment Relations Board could not enforce the law

"It's wonderful, just wonderful," Katter told CNS News about her victory.

She told the conservative news site that she was "really excited" about the ruling and that it was "absolutely worth the struggle."

The National Right to Work Foundation helped Katter with her lawsuit and Stefan Gleason, the NRWF's vice president, praised the judge's ruling as "a victory for employee rights and the freedom of conscience."

When I was a AFL-CIO member I was allowed to pay my dues minus the ammount spent on political support. They didn’t like it and they fought me every step of the way but it was written into our bylaws that I could refuse to support a candidate officially endorsed by the union.

Its only natural that the NEA would want to kill children before they have to deal with them. Its another way of getting the 5-1 classroom ratio they want.

Good decision, but how did the blatantly unconstitutional exemption for only Seventh Day Adventists and Mennonites last more than 24 hours in the first place? If ever there was an example of unconstitutional government establishment of religion, this is it.

This *is* great news. Hopefully, it will lead to the U.S. Supreme Court overturning Abood v. Detroit Board of Education, which allows unions to charge compulsory dues even when some of the money was used for political activities opposed by the union member. (Abood allows union members to ask their money not be used for political purposes, but since money is fungible the unions just use a larger percentage of non-objecting union members for their political activities.)

UAW bylaws as well. The woman who, up until recently, was my fellow Lansing-based freeper pal (still a pal) was a UAW member at GM. Every single year she'd have to file all kinds of paperwork in order to keep that bit of money from going into some damn lib candidate's pocket, but she did it.

My brother has been UAW for the past nine years. He didn't know until last summer, when I told him, that he was able to withhold.

I wonder how her persecution may manifest itself. At any rate, I hope she sues the pants off the NEA.

You may recall a few years back, I think it was in California (?), that a woman was not able to be considered for high office in the teacher’s union in that state because she was Roman Catholic. The irony of the whole thing was that the woman was a screaming pro-abort and made that plain to for all to see. It still wasn’t enough to placate the Death at All Costs crowd.

In that instance I believe the woman went back and crawled under her rock,
