All charges against former San Jose Mayor Ron Gonzales and his aide Joe Guerra were dropped by a Santa Clara County District Court judge.
The charges, including bribery, stemmed from a deal with trash hauler NorCal Waste Systems Inc.
Charges against Norcal were also thrown out.
Judge John Herlihy signed an order Monday dismissing the charges. In the order, Herlihy cited errors given to the grand jury as grounds for throwing out the entire indictment against Gonzales and Guerra.
"There is no question that Norcal, defendant Guerra and defendant Gonzales were delinquent in their responsibility to be open and to fully disclose their knowledge, actions and policies," Herlihy wrote in his 33-page order.
He went on to write: "However, this court's responsibility is to consider whether to set aside the indictment for a lack of legal cause based on the proceedings before the grand jury. As indicated above, the prosecution made erroneous instructions to the grand jury considering bribery, labor law, and the falsification of public records. The court concludes that given the complexity of this case, the instructional errors, in their totality, undermined the grand jury's determination of probable cause on all the charged counts.
"Therefore, the indictment is dismissed in its entirety."

I hope we have a prosecutor who will reopen and refile the charges.....
Citizens should not be denied Justice - when another “civil servant” incompetently prosecuted a fellow civil servant criminal...
That’s just a little too convenient....
One day, these crooked bastards will drive the public to the same measures used in the past to "right wrongs"... Next step — will be a lynch party...
