If he was 25 i’d agree with you but a 15 year old minor and a 17 year old minor having consensual relations should never be considered rape. The law was badly flawed and the DA lacked judgment and human decency.
I think the problem here is that the prosecutor simply failed to charge these thugs with everything. Maybe he got carried away with the pleas made by the 4 other thugs and forgot to tag this 5th guy "out" when he decided he wanted a trial.
The case is not really about oral sex ~ it's about serial rape and whether or not this society thinks that's a bad thing.
