ATLANTA — A Georgia judge on Monday voided a 10-year sentence given to a man who was convicted while a teenager of having consensual oral sex with a 15-year-old girl.
Monroe County Superior Court Judge Thomas Wilson voided Genarlow Wilson's sentence and dropped it to misdemeanor aggravated child molestation with a 12-month sentence, plus credit for time served. Under the new ruling, he will not be required to register as a sex offender

So you plan to take the judgment out of a judge. Make one written system that is enforced evenly regardless of the situation because it is the rule of law. The justification: nothing less than that we should follow the rule of law because it is the rule of law. That there is law worship. Nowhere have you addressed the concept of justice. Perhaps you are arguing that in our modern society justice has nothing to do with the rule of law.
She was not unconscious and this kid was acquitted of this crime. She was loaded and a jury believed she did consent.
Actually, there was no plea bargain. The boys who agreed to a plea bargain are in jail to this day. This was an acquital.
What does their race have to do with their guilt or innocence? 5 pled guilty.
Actually, no...but I don't extend their discretion to the degree you do. Judges are finders of fact and law, guiding a judicial process.
They are not kings, and I believe it follishness to suggest they should be. Their roles, as with all other roles involved (legislative and executive) are limited and defined.
Yes, we need to make sure that we don't let the concept of justice get intertwined in our legal system. Think of the consequences! I find it interesting that you brush off the concept of justice so easily.
I will look up the story printed somewhere else, it had more information on the what the tape showed and the girl who claimed rape. If memory serves I believe she either decided not to answer questions at all at the trial, or balked at some of the questions asked. I will find the other better article, this kid was not some angel that got a BJ by his younger girlfriend, the DA and the judge agreed he was way out of line that night.
The 5 fellows who pled guilty thought it was rape.
Of course they aren't and I've yet to see anyone make that assumption. However, when you pack an overnite bag, go to a hotel room with 6 guys, a video camera, drugs and alcohol a reasonable person could assume you are a willing participant.
Oh please-she was not kidnapped. She became inebriated through her own efforts. The jury found this boy innocent. By the way, the accused does not have to prove anything. The DA does and apparently he did not.

The 17 year old was unconscious when some of the males raped her and obviously impaired when wilson did.. This was not 2 frisky kids in the backseat with a sixpack.

Actually, if you read about it...they were threatened with massive amounts of jail time and acutally signed these agreements without parents even knowing about it to avoid 25 years or so.
