LACONIA, N.H. -- A teenager faces deportation after pleading guilty to statutory rape of a 14-year-old girl in Lake Winnipesaukee.

Joverlyn Garcia, 18, of Methuen, Mass., accepted a plea offer by prosecutors Monday after a jury had been selected for his trial. Garcia is from the Dominican Republic and not a U.S. citizen.

Garcia had faced two counts of aggravated felonious sexual assault and two counts of felonious sexual assault. He pleaded guilty to a single charge of having sex with an underage girl.

He faces 3 1/2 to seven years in prison, but could serve less time if federal authorities move to deport him quickly. Superior Judge Larry Smukler had not set a sentencing date.

Defense attorney Mark Sisti said the threat of deportation was as serious as prison time for Garcia, who has few ties to the Dominican Republic.

"A majority of his family lives here," Sisti said.

Laconia police said the girl reported she had been assaulted in the water at Weirs Beach after Garcia offered to teach her how to swim.

Garcia had argued the girl was a willing participant. However, the legal age of consent in the state is 16, and the girl also denied she had consented.

Belknap County Attorney Jim Carroll said the plea would spare the victim the ordeal of a trial. He also said federal immigration officials assured him the deal would lead to Garcia's deportation.

Well then, he is not "of Methuen, Mass" then, is he? He is of the Domican Republic.

Aren't family members covered under the proposed Republican amnesty? Perhaps he can claim citizenship after the amnesty passes, and avoid the deportation.

This upstanding young man is an illegal immigrant which is legally and morally cause for deportation in and of itself. By pleading the rape punishment down to deportation without a serious prison sentence beforehand, he’s essentially getting out of rape free.

Nah, then we'd really be accused of being Nazis. A nice color dip might work. How 'bout orange? Dye all the illegal aliens orange. Then the open border lobby would whine 'that's racist'. It's all beyond absurd.

Is it just me or does the MSM seem more ready to believe a 32 year old stripper’s claim of rape than a 14 year old girl? Clearly from their point of view, raping an adult stripper is a much more serious crime than the rape of a minor.

I’ll grant the statutory nature of it, but I’m having trouble envisioning a successful rape in water more than a foot deep.

I see this crapola happening more & more.....the illegal RAPERS/MOLESTERS are allowed to plead guilty for their SEX CRIMES & then serve little, or NO US jail time if they agree to 'self-deport'....

Simply, DISCRIMINATION by US courts.......let the ILLEGAL sex criminals serve US jail time & register (for life) just as the 'citizen' criminals are ORDERED to do.

Actually I think you have a great idea, not a brand but a tatoo that would allow us to check if he has been here before. Tatoos are hard to get rid of. Of course all the bleeding hearts would scream and cry about it but I think it would be a good thing.

It's not the age of the victim, it is the color of the assailant that determines the outrage of the MSM.
