Yes, but motivation is a legitimate factor in sentencing. Which is essentially where in practice it resides in the states, though I admit often through laws which address motivation before the fact rather than in the sentencing process.
Again, this law, which I oppose, doesn't support some groups over others. For example, any religious based crime would fall under it's umbrella, it's not limited to minority religions. Same with race and sexual orientation, though I acknowlege there aren't many assaults on hetereosexuals based on their orientation. If there were, they'd be actionable.

See 161, I don’t like the bill, but it’s not about controlling thoughts, beyond being a political statement, it’s essentially a wrongheaded way of addressing sentencing. And motivation is a legitimate factor in sentencing. As to whether the random drunk commiting an assault is less of a risk on release than a racist commiting a racist attack, we’ll have to disagree on that. That’s a sentencing function, which is why most crimes, even violent crimes, allow for a wide range of sentences in most states.

DNC Dean Says Giuliani’s ‘Personal Life Is A Serious Problem’
Fri Apr 27 2007 09:37:49 ET
Democratic party chairman Howard Dean said on Thursday that Rudy Giuliani “personal life is a serious problem.”
Dean sent the warning on CNN’s SITUATION ROOM with host Wolf Blitzer.
Chariman Dean said the former New York City Mayor “has a lot of character issues that he has to answer for. And overwhelmingly, Americans are going to vote on honesty and integrity.... We’ve begun to reach out to evangelical Christians, and that’s a real problem for him. His personal life is a serious problem for him.”
BLITZER: Well, describe those character issues...
DEAN: No, I’m not going to get into that stuff. I don’t like attacking people on their personal lives, but I can assure you that in the Republican primary, given what went on in the 2000 Republican primary in South Carolina between George Bush and John McCain, those attacks will be made in the Republican Party.
Developing...

well have to disagree on that.
Fair enough my FRiend. Althought we differ in view a bit, in the end - we're sitting on the same side.
Until the next thread,

"Come on. If they commit an act in self defense, this law does not apply. You know better."
Well, I don't know better. I suppose I'm stupid. Lots of things are promised before laws are passed to make them more palatable. However, no one knows how courts will rule or even how prosecutors will choose to enforce a given law. The original Civil Rights Act came with an absolute promise that it would not be used to discriminate against whites or to give blacks preferences over whites. I am old enough to remember this. Look what happened.
To: yuta250
Well, you seem to think you know what party I'm in, since you stated I'm in the wrong one. Seems as if you have trouble comprehending your own writing as well as mine.
Go back and try again with my original post. You may (or may not) finally discern that it is a stark warning against such laws and our own government. So what party does that position put me in sage one? (no, chief, it doesn't have anything to do with spices).

Oops, I went back and read your original post (that I only skimmed thru the first time) and now see that I’ve misinterpreted you. My apologies, you are correct, I should be more careful in my reading. Sorry about that.

Congressman Gohmert asked, If a minister was giving a sermon, a Bible study or any kind of written or spoken message saying that homosexuality was a serious sin and a person in the congregation went out and committed a crime against a homosexual would the minister be charged with the crime of incitement? ...
Here's your How to HATE Book: the Bible!!
Genesis 13:13 Now
the men of Sodom were wicked and were sinning greatly against the LORD.
Genesis 18:20-21
20. Then the LORD said, "The outcry against Sodom and Gomorrah is so great and
their sin so grievous
21. that I will go down and see if what they have done is as bad as the outcry that has reached me. If not, I will know."
Genesis 19:4-7
4. Before they had gone to bed,
all the men from every part of the city of Sodom--both young and old--surrounded the house.
5. They called to Lot, "Where are the men who came to you tonight? Bring them out to us so that we can have sex with them."
6. Lot went outside to meet them and shut the door behind him
7. and said, "No, my friends. Don't do this wicked thing.
Psalms 12:8 The wicked freely strut about when what is vile is honored among men. More? |
Isaiah 3:9 The look on their faces testifies against them; they parade their sin like Sodom; they do not hide it. Woe to them! They have brought disaster upon themselves.
Ezekiel 16:49-50
49. "`Now this was the sin of your sister Sodom: She and her daughters were arrogant, overfed and unconcerned; they did not help the poor and needy.
50. They were haughty and did detestable things before me. Therefore I did away with them as you have seen.
But there IS hope!!!
1 Corinthians 6:9-11
9. Do you not know that the wicked will not inherit the kingdom of God? Do not be deceived:
Neither the sexually immoral nor idolaters nor adulterers nor male prostitutes nor homosexual offenders
10. nor thieves nor the greedy nor drunkards nor slanderers nor swindlers will inherit the kingdom of God.
11. And that is what some of you were. But you were washed, you were sanctified, you were justified in the name of the Lord Jesus Christ and by the Spirit of our God.
If you could NOT change, you would be in most pitiful shape.....

California Penal Code section 422.6 offers a wider interpretation of hate crime, defining it as No person, whether or not acting under color of law, shall by force or threat of force, willfully injure, intimidate, interfere with, oppress, or threaten any other person in the free exercise or enjoyment of any right or privilege secured to him or her by the Constitution or laws of this state or by the Constitution or laws of the United States because of the other persons race, color, religion, ancestry, national origin, disability, gender, or sexual orientation, or because he or she perceives that the other person has one or more of those characteristics.[1]

Christ died for homosexuals, that they may repent (turn from homosexuality) and have eternal life with God. Indeed!
[Except at Metro Church in Indianapolis (gay group). It's 'pastor' tells them that Jesus ACCEPTS homos, just the way they are! Google billboard vandalism]

Thank you but I don't need you to fix it. From all the noise and screaming we're hearing from gay rights people one would think they were a majority. They're not. IMO, the majority Americans know that abortion is wrong and the gay lifestyle is twisted.
The fly over states will put up with all the bull they're able to stomach from these two groups then they'll loudly say, enough.
