Exactly. White had moved over into Red’s blind spot, and Red saw that the SUV was in the outside lane so he rolled back into his original lane and sped up — just as White pulled into the SUV which was the only cause of this accident.
He was speeding.
Your scenario makes sense except that the driver of the red truck said he pulled back into the lane AFTER he had avoided the accident. For both you occupy the same piece of road he would have to have seen that the other vehicle was there. That isn’t AFTER, that’s while its happening.
The taxpayers of New Jersey had better hope the driver of the white truck doesn't hire a top civil litigation law firm and sue the daylights out of the state.
