Nifong Issues Apology to Ex-Lacrosse Players

Durham — The local prosecutor who charged three Duke lacrosse players with raping a stripper apologized Thursday, acknowledging the decision of state prosecutors to dismiss all charges against them was correct.

"To the extent that I made judgments that ultimately proved to be incorrect, I apologize to the three students that were wrongly accused," Durham County District Attorney Mike Nifong said in a statement.

I understand your point very well.

A shame....before this happened, I considered Duke a most honorable school...

(thankfully he's already graduated from college) but I would never send my son into that climate, if I were in that position today...

..but then, one has to realize other 'prestigious' schools are just an incident away from being the same.....

"to be incorrect": incorrect sounds so innocent doesn’t it?

Like I said -- he makes it sound like an honest error in judgment, not a deliberate criminal conspiracy to suppress exculpatory evidence in order to keep a bogus prosecution alive.

Imus has been fired. His career in radio is destroyed. The Duke Lacrosse players have been severely hurt and Nifong walks.

This is incredible. We need to start making these racial shisters and extortionists pay for their terrorizing of people.

Granted - I was just remarking, how it was a pretty transparent move.

AG Cooper REALLY threw him under the bus, with his press conference. I was astounded.

And Cooper threw Durham under the bus, with him. At that, I was in shock.

His apology is for any judgments he made that may have been incorrect.

The only mistake he made that was an error in judgment (rather than a willful abuse of power) was in believing that he'd get away with it.

A prosecutor has immunity if he acts “within the scope of his employment.” This immunity flows from the State’s Sovereign Immunity. However, if he acts outside that scope, particularly with malice, he is open to personal liability.

I think his statements to the press might just pierce his immunity. It's not a DA's job to give interviews and make disparaging remarks about defendants.

If the ethics committee finds that the remarks to the press were improper, then that seems like prima facie evidence that the remarks didn't occur within the scope of his job.

I hope he gets his ass handed to him by the ethics committee & gets sued into bankruptcy by the kids.

He is immune from Civil Actions arising from his conduct in Office.

He is immune to civil actions arising within the scope of his office. Committing crimes (e.g. conspiring to conceal exculpatory evidence) does not fall within the scope of his office, and that exposes him to civil (as well as criminal) liability.

I understand that one of the issues considered by the bar/judges will be if he has shown contrition. This mealy mouthed press release does not qualify as a real apology, and it was not given to the players themselves...only a handout to reporters. He really is stupid and self-centered.
