Wars should be settled on the battlefield. You can not adjudicate war. If a conflict can be settled by men with suits and briefcases, it isn’t war. To imagine that the suits can come in after the war, and re-fight it, is to misunderstand the nature of war and to misunderstand the nature of law.

War exists when law can not contain a conflict, and rule of law is broken. War ends when the facts on the ground have been re-drawn such that rule of law can resume. The period in between is by its very nature extra-legal. Its a mistake to pretend otherwise.
