SAN JOSE Judge orders discharge of an anti-war Marine

A federal judge has ordered the Marines to discharge a San Jose lance corporal as a "conscientious objector" who had an aversion to killing and participating in war.

Robert Zabala, 23, must be released from the Marines Corps Reserves by mid-April, U.S. District Judge James Ware said in a 21-page ruling Thursday.

"We're very pleased with it," Zabala's attorney, Stephen Collier, said Monday. "I think it's a good decision and that it makes clear to the armed services that they can't deny conscientious-objector discharges from the military."

As a former Marine, my wife was a former Marine, one of my sons was a former Marine and I have a son still active duty Navy, I call this puke what he really is ....in the words of a former DI..”Your a maggot and a Sh*t Bird.”

He should have been weeded out in Boot Camp as a non hacker who would prefer to see his friends killed rather than kill the enemy.

Good riddence to bad trash.

Despite evrything that has been said about this guy, I doubt very seriously if a Federal Judge has the authority to order the Marine Corps to discharge one of their own. I believe this order will be appealed and overturned. It may take a while though if the appeal has to go the 9th Circuit first.

If somebody is a “consciencious objector” he would never have joined the Marines.

The President, who is the Chief of the Military, should ORDER the Marines to ignore this idiotic edict by a liberal tyrant in black who has no Constitutional right to interfere with the condcut of the military in wartime.

Ooops. I forgot. George Bush is President, not Andrew Jackson.

This is a typical example of a POS Poggie bait trooper who has no business in the Corps in the first place. Je knew what to expect to begin with and how he can’t handle it BS. He only joined to get the ED Bennies and the bonus. Shove this As#$$#le in to Leavenworth with 6-6 and a BCD.

Or better yet, make them sign a sworn statement when they join that they have no aversion to participating in real military action.

Then if they later try to claim objector status, the Marines can sue them.

See how the free riders like that.

come on now folks, there is plenty of useful things for a conscientious-objector to do in the military.. rocks to paint, potatoes to peel, dishes to wash, latrines to scrub.. i could go on and on :-)

Why would you join the military if you are a conscientious objector? This is just another attempt to make the pea brained public think we have a draft or that our military are forced to join. They can’t stand it that we don’t still have the draft, it galls them to no end so they pull stunts like this one and the one with the Lt. from Hawaii.

Makes you wonder what he thought the military was all about. However, he is probably looking for a way out. This seemed the most expedient. Some folks just can’t adjust to discipline and responsibility. Usually, basic training weeds them out.

The article does not mention if he was in combat or not. I’ve seen guys freeze-up under fire for the first time. Most of us figure out what to do. A friend of mine had a guy blow his brains out in a bunker one day. His last words were “I just can’t take this anymore.”

At 23, this guy should have had better coping mechanisms and should have understood that especially the Marines, are paid to kill people and blow things up. That is war....duh!
