CA: No charges in water intoxication death

SACRAMENTO, Calif. - Prosecutors said Monday they will not file criminal charges in the death of a 28-year-old woman who participated in a radio station's water-drinking contest.

The district attorney's office said the behavior of staff at station KDND-FM did not rise to the level of criminal activity.

"There were no observable indications or symptoms that Jennifer Strange was experiencing a serious medical emergency which would have required station employees to seek or administer medical aid to her," the district attorney's office said in a statement.

Strange died Jan. 12 after taking part in an on-air contest to see which contestant could drink the most water without having to go to the restroom. The coroner's office ruled that Strange died of water intoxication.

At one point during the contest, a listener who identified herself as a nurse called "The Morning Rave" program to warn the disc jockeys that the stunt could be fatal, according to an audio tape of the broadcast.

"Yeah, we're aware of that," one of the DJs responded.

Another DJ laughed: "Yeah, they signed releases, so we're not responsible. We're OK."

Strange's family has filed a wrongful death lawsuit against the station, which fired 10 employees following the death.

The pre-event ‘’Release’’ is meaningless. The station will pay dearly for the deadly inducement.

The death is the ladies fault and her fault ONLY!!!!
She could of gone to the bathroom at anytime. She chose to hold it to long. NO one held a gun to her head.

Local TV news reported tonight that the lawsuits have already been filed. The idiot DJs are going to lose a lot more than their jobs.

This was the right call.

I don't like it when stupid people take advantage of even stupider people, but dang it, there shouldn't be laws against being stupid. There's enough laws already that try to legislate common sense. Can't be done, and every time somebody tries, it's another shot at the Constitution.

I feel bad for the woman's family, but geez, it's not like the cases of frat hazing where there's physical coercion or alcohol involved. She had her judgment, and chose not to use it.

Civil case, sure, have a good time. But no criminal case. There's already too much in this country that's been made illegal in the name of legislating common sense.

Less worthless laws == better government.

Personal responsibility is so passe. Watch and you will see, most will blame the DJ’s and not the actual ADULT who committed the act.

I swear, with a large group here supporting Rudy for President and blaming others for their troubles, I sometimes wonder if I fell in a rabbit hole.

It’s common knowledge that water intoxication can kill you. This goes beyond personal responsibility. I think someone should be charged with involuntary manslaughter.

Both the station DJ’s and the woman are at fault, waiver or no waiver.
Why not have a contest where one jumps from a high-rise window?
If one was stupid enough to attempt, who then would be at fault?

This goes beyond stupid, but there still is the manslaughter issue. They may not have intended to kill her but they knew going in this was potentially very dangerous.
