Senator introduces legislation to lift D.C. gun ban

WASHINGTON, DC -- Senator Kay Bailey Hutchison (R-TX) introduced the District of Columbia Personal Protection Act of 2007, a bill to restore Second Amendment rights in Washington, D.C.

“The constitutional rights of law-abiding citizens do not end when they cross into the borders of the District of Columbia,” said Sen. Hutchison.

“The gun ban has been proven ineffective by the trend of increased violent crime in the District. The citizens of Washington, D.C., deserve to have the same right to defend themselves and their families in their homes that lawful Americans enjoy.

“This requires both a legislative and judicial remedy. I hope the Parker case goes before the Supreme Court and that the court asserts that the right to bear arms is an individual, and not a collective, right as the D.C. Circuit and Fifth Circuit Courts have affirmed.”

The District of Columbia enacted the Firearms and Control Regulations Act in 1976 that banned handguns and required rifles and shotguns to be registered and stored unloaded and either locked or disassembled, giving it the most restrictive gun control laws in the nation. Prior to the gun ban’s implementation, the murder rate in the District was on the decline. Following the ban, the murder rate began to rise while violent crime was decreasing nationally. According to the FBI’s Uniform Crime Reports, in 2005, the most recent year from which statistics are available, the District of Columbia led the nation in violent crime.

Unfortunately, if this passes somehow, then the D.C. circuit case will never be reviewed by the Supreme Court, and the decision will lose precedential value. The bill is in theory a good idea, but the time is not yet.

And if the push is to get SCOTUS to write an opinion or rule on the issue...

I would say y'all had better be careful what you wish for...

The Supreme Court of the United States of America is not a lock on this issue...yet...Probably never will be...

And if by some chance the court rules that the Right to Keep and Bear Arms is a "fundamental right", instead of an "individual right" or even more important than that, it is an "inalienable right"...Its ALL over...

You will see gun bans enacted from here to Christmas (before Christmas is even banned)...

Not yet. Karen Bailey Hutchison would be better advised to intoduce a federal Shall Issue CCW bill. That would give gun rights real teeth in America.

Fortunately the DemocRATS won't let this come up for a vote. They even squashed their own pet bill to give DC a vote in Congress, because Republicans got an amendment on the bill abolishing the DC gun ban.

There's a reason DC is not part of a state. It was intended as a neutral site for the Capitol. The founding fathers didn't want a hostile state legislature or local government controlling it. If permanent residents of the district don't like that, they should move elsewhere.

I think we are all mad at the government...but very few people are interested in following in McVeigh's footsteps...but all it takes is one to really ruin the day.

Sure. The RINO just promoted having Love Field in Dallas reduce the gates in order to give Southwest Airlines and American Airlines an oligopoly over airfares in DFW. Residents of DFW pay an inordinate premium to AA because of legislation like this. Don't want more competitors? Call Kay Bailey. Want to tear down the old Legends terminal ($100mm) at Love Field to prevent new competition? Call Kay Bailey. Want to prevent new air travel from McKinney TX? Call Kay Bailey.

Hey Kay Bailey...who benefits from reducing the gates from 32 to 20? your voters? The common little traveler?

Major RINO...or maybe a better description would be Country Club Republican
