Federal court says prayer is OK, but ‘mere worship’ not protected by the First Amendment

WASHINGTON (Map, News) - There they go again! The hard-left majority of the 9th Circuit Court of Appeals tried again earlier this month to create out of thin air a constitutional principle of hostility to religion. It ought not succeed.

In the case of Faith Center Church Evangelistic Ministries v. Glover, the majority overturned a perfectly reasonable preliminary injunction issued by a district court. The injunction ordered the Antioch Library in Contra Costa to allow Faith Center the same opportunity to use library meeting rooms that Democratic Party groups and other community organizations enjoy, at least until the court can hear and decide the full case on the merits.

The preliminary injunction was designed to allow Faith Center to exercise its First Amendment rights to free speech. The 9th Circuit majority agreed that the First Amendment was at issue, and it agreed that even the temporary loss of First Amendment rights would constitute “irreparable harm” if indeed it turned out that those rights had been unconstitutionally abridged. And it duly cited longstanding precedent that the potential for irreparable harm is sufficient for a preliminary injunction.

Yet despite all this, it vacated the injunction. This is astonishing.

The “balance of hardships” (another test in determining whether an injunction is appropriate) clearly weighs in favor of the religious organization, not the library. If the library allows a religious meeting to be held behind closed doors pending constitutional review, no permanent harm is done the

BTW. As long as there are algebra exams in school, prayer will also be there.

If the taxpayers who funded the library are OK with the church group meeting there then it should be nobody else's business. I would hope that those in charge of the library are answerable to the elected representatives of the people paying the bills.

I want freedom of religion to trump in this case. I don't care if it was Christians, Muslims, Jews, Buddists, or Wiccan using that room. If it is available to one group, it is available to all. Now, if in the course of that meeting they start chanting "death to america", then there might be a case to throw them out. Do not sacrifice freedom for security, for you will lose them both.

Judeo-Christian morals and ethics made this Republic possible. They're still needed in order to keep it.

What's the matter, is someone beating you over the head with a Bible? Forcing you to pray several times every day? Get baptised? Pay tithes?

You seem to jump to conclusions. I am a Christian but have noticed that Islam is being allowed to intimidate every other religion in the US by taking anybody to court because they don't agree that Mohammad is the prophet!
