Don't be naive. There is not future in suing Nifong or Ms. Magnum. Before this case started Nifong was borrowing money from friends to keep is campaign for DA alive. He as worked for the government all of his life. He may have a retirement account, but creditors cannot reach that. He has no money and a judgment against him will not be worth the paper it is printed on. Why would anyone spend >$50,000 to get a judgment against this guy? What lawyer is going to waste his time on a contingency fee when there is nothing to collect?
Do you really believe that Crystal Gale Magnum has enough money to justify paying the roughly $100 one has to pay the Clerk just to file a civil suit. If you got a judgment against her for $10,000,000.00, you would never collect a cent.
Having said that, where these guys might get some traction is to sue the State of NC and the City of Durham in Federal Court. As nearly as I can tell, Nifong is an agent of the State of NC. The Durham Police are agents of the City of Durham. I believe that there is some authority under the United States Code to the effect that governmental principals can be held liable for certain actions of their elected or appointed agents.
I am certainly no expert in the field, but I have seen cases where governmental entities have significant liabilities when their agents knowingly and flagrantly violate individual constitutional rights. Take what I say here with a grain of salt because the last time I looked at this stuff was in the moot court competition of my legal bibliography course in law school in 1976. Since then my memory has faded and the law has changed.
I do not see how these guys can make much headway with the Duke Faculty. There might be some strained legal interpretation that might give them some claim against Duke U for tossing them out, but the general rule is that when dealing with private schools, they can toss you for what ever reason they want unless it is on the basis of race, creed, color, national origin, sex, etc. As far as the Duke 80 faculty is concerned, they have the absolute right to make fools of themselves without fear of being sued.
