The separation of powers will be the exact reason the USSC won't hear the case and they'll advise congress to change the law if they don't like it.

This is something that can't be changed by law. It would need to be done by constitutional amendment or court ruling.

Separation of Powers would require changing the Articles which I believe are sacrosanct.
