It's a hate crime too because he hates her political beliefs but unlike religious or SEXUAL beliefs, political beliefs are not protected from harassment and physical violence by special laws.

I say get the FEC on this. It is voter intimidation and I don't give a damn that we are not in an election season. It is the same type of threat.

He assaulted her when he yelled at her and she felt threatened. When he touched her, he added battery to the charge.

No, that's assault and battery. Under California law to constitute battery, an offense must be intentional and must be committed to inflict injury on another- but provocative insults intended to incite escalation, racial epitaphs and politically-related attacks have been found to constitute *injury* under the law.

Assault and battery can be prosecuted as either a misdemeanor or a felony. This frequently depends on the nature of the crime and they seriousness of the injuries.

It's assault and battery, and under the circumstances is grounds for employing force in self defense. Even lethal force.

In a sane State, anyway.

Yep, that's assault. Under the law, you are allowed to protect yourself in any means you feel to the level you are threatened. Glock's do very nicely.
