(March 20, 2007)--A Dallas man with a history of robberies was executed Tuesday evening in Huntsville for murdering a convenience store owner during a 1997 holdup.
The execution of Charles Anthony Nealy, whose 43rd birthday would have been Friday, was briefly delayed while the US Supreme Court considered his 11th hour appeal Tuesday evening.
The high court declined to block the execution.
Nealy was the ninth death row inmate put to death this year in the nation's busiest capital punishment state.
Nealy had at least three earlier convictions for aggravated robbery when he was accused of murdering Jiten Bhakta.
He also had an extensive juvenile record for shoplifting, burglary and theft.

I dont believe that the state of Ohio was at fault the U.S. Supreme Court blocked their latest execution.
I just wish we could do anywhere as well here in Tennessee.

I'm no lawyer, but a couple of reasons for Texas' success spring to mind.
1. Automatic appeal. In Texas a death sentance is automatically appealed to our Court of Criminal Appeals. This is our highest criminal court. At first glance it may seem that this would slow things down, but what it really does is cut away all the intervening levels.
2. Federal Appeals. Federal appeals usually do not work for a few reasons. Texas has a LOT of experience in dealing with these appeals. Also, Texas prosecuters usually will not ask for the death penalty without a very strong case. Such cases stand up well on appeal.
3.Texas is a huge state, population-wise. In the 2000 census only California had more people. Tennessee is 16th in population. Naturally, with more people than Tennessee we are going to have more misfits total. That alone would result in more executions. If Cali was as conservative as Texas they could outstrip us in exections.
