The incoming House chooses the President. The House would vote by state delegation, not as individual members. It would take a majority of the state delegations to elect the President. The incoming Senate chooses the VP, Senators would vote individually. The Electoral Votes are officially counted on by Congress on January 6th, 3 days after the new Congress convenes on January 3rd.

No.......the House at the time of the election. They aren't going to wait until the following January to say who is the president.
