Under what authority does Congress give the FDA the power to regulate tobacco? The Constitution does not give Congress the power to regulate tobacco.
I have no idea. I guess they can do anything they want to!

After 17 years, I quit cold turkey 4 years ago. Haven't had a single lapse. God had nothing to do with it. Nor did Congress.
Nicotine is a psychoactive addictive drug. Open and shut case anytime the nannies want to push the issue.
While we both agree that nicotine is a drug as the word is commonly used, the word drug has a different and more specific meaning under the Food Drug and Cosmetic Act. It is defined as a substance used to cure, mitigate or treat disease. For this reason, new legislation would be needed in order to empower the FDA busybodies to regulate tobacco as badly as they regulate everything else.
