The bizzare saga of Anna Nicole Smith just got stranger. Two of Smith's lawyers are on TV now answering press questions. Birkhead's request for an emergency DNA test of the baby has been denied. When one of Smith's lawyers was asked about the ruling, he said that 'DNA is not necessarily conclusive,' which is news to me. Both Birkhead and Smith contend that they are the baby's father, and the two most likely executors of a fortune worth $1.6 billion.
The judge ruled he cannot rule on any emergency petition because he believes the case is under Bahamian jurisdiction.
One of Smith's attorneys then got even wierder by saying that 'there as some allegations that the baby's hair has been dyed,' suggesting an attempt to alter its appearance re. paternity.
This case looks like the Tabloid Full Employment Act of 2007. I feel bad for the baby.
I wouldn't think that a baby's hair color would mean anything or skin coloring etc since babies change so much and a baby can be born with very dark hair etc and later it is light or visa versa. Either way I feel so very sorry for that poor baby. I worry who will have the child and raise her out of love and not for the money. I never had a good feel for the Birkhead guy - so obvious he is out for the money and not the interest of the baby but I don't have a good feel for the lawyer guy either. He hung on her like she might bolt and there would go his meal ticket!
I'm sure Gloria Alred would be more than happy to "represent" the baby. /s

I understand about the birth certificate taking precedence over DNA in the Bahamas, but is the baby a citizen of the Bahamas? Why would the Bahamas be the "only" place this court drama could take place? Were they living in the Bahamas? What was their legal domicile?
Yeah, it sounded as though if the man and woman were living together as a household and the name was on the birth certificate, the man is deemed the father.
I just wonder what the deal is with the biological father. This is all such a mess and too many people have died in too short a period with too much money involved.

It might not be conclusive if the two claimants were closely related to each other, but given that they're not it should be pretty darned conclusive in terms of ruling one of them out (technically the baby's father could still be a close relative of the claimant whose DNA was a good match, rather than the claimant himself, but a reality could pretty quickly rule out that possibility).

Yes, they were living in the Bahamas and had set up a household as mother and father to the baby. The lawyer kept repeating that, but it just wasn't getting through. She had left the baby in the Bahamas while she came to the US to deal with her legal problems, obviously because she was afraid to subject the baby to the US legal system.
The baby is hopefully the heir. If so, and I were the judge, then the money would be put in trust for the baby at some bank's trust department, and the putative fathers would not be able to touch it. My suspicion is that they'd suddenly lose interest in the paternity case.
The baby may be in the Bahamas, but the money is in the US.
I'm sure some big name attorney will "volunteer" his services. Poor baby!
Birkhead may have an uphill fight. Stern is a lawyer and we know how they stick together (thick as theives comes to mind), plus Stern probably has a lot deeper pockets than Birkhead.
DNA evidence is given as a percentage. So I guess in that sense it's never 100%. But true parentage is usually up in the high 90's. Pretty conclusive. He's playing with language, I imagine.
I doubt if Stern has changed any diapers.
However, neither the baby nor either of the paternity claimants are Bahamian citizens. The paternity suit was filed in a US court, over an infant US citizen. There should be no problem getting the baby back here via an extradition order. Probably couldn't get Stern back here against his will, since he isn't accused of any crime. However, if he's a no-show when ordered to appear in US court re the paternity case, he could lose by default.
Maybe the bio baby-daddy is a room service guy in Vegas named Jose.
This thing will get absolutely hilarious if it turns out neither of the two claimants is the bio-dad.
