Border-agent investigator had tie to smuggler

Played major role in Ramos-Compean case but name blacked out in report

According to official documents in WND's possession, a Department of Homeland Security agent played a major role in managing the drug smuggler and conducting the field investigation in the incident that landed Border Patrol officers Ignacio Ramos and Jose Compean in federal prison for more than a decade.

Yet, in the heavily redacted 77-page DHS report submitted to Congress Wednesday there is no explicit discussion of the role DHS Special Agent Christopher Sanchez played in the case.

Rep. John Culberson, R-Texas, yesterday called for the resignation of four DHS investigators, including Assistant Inspector General Elizabeth Redman, after DHS Inspector General Richard Skinner testified under oath his deputies had lied to Congress about non-existent reports that were supposed to have established Ramos and Compean as rogue cops who wanted to "shoot some Mexicans."


Osbaldo Aldrete-Davila

WND has obtained a copy of the government-issued border pass given to Osbaldo Aldrete-Davila, the drug smuggler granted immunity to testify against Ramos and Compean. The border pass allowed multiple entries to the U.S. and carried the signature and badge number of Sanchez.

The border pass appears to have been issued March 16, 2005, the day Sanchez brought Aldrete-Davila to William Beaumont Army Medical Center in El Paso, Texas, to have a bullet removed from his right thigh.

"Aldrete-Davila was issued what amounts to a 'Gold Elite' border pass," Andy Ramirez, chairman of the Friends of the Border Patrol, told WND. "With the stamp for multiple entries into the United States, Aldrete-Davila didn't have to run the back roads as a drug smuggler any more. He could tell his drug bosses in Mexico that he could drive their loads right through border crossing points without much worry."

WND previously reported Aldrete-Davila was implicated in a second drug bust in October 2005, subsequent to the Feb. 17, 2005 incident with Ramos and Compean in which he abandoned a 1989 Ford Econoline containing 743 pounds of marijuana driven across the border from Mexico.

"With that border pass, Aldrete-Davila had the green light," Ramirez told WND. "He might have been indicted if the vehicle he drove in October 2005 with 1,000 pounds of dope was identified back to a border-crossing photograph, but he probably never had to be arrested."

The prosecutor of Ramos and Compean, U.S. Attorney Johnny Sutton, has told WND that Aldrete-Davila was never arrested a second time for a drug offense in October 2005, but Sutton has never denied the smuggler was indicted for such an offense.

Medical records obtained by WND clearly establish the bullet wounds suffered by Aldrete-Davila involved a lateral wound to the left buttocks, not a "shot in the back" as repeatedly claimed by Sutton.

The medical records document that March 16, 2005, Dr. Winston Marne removed a large bullet fragment from Aldrete-Davila's right thigh. The records indicate bullet fragments were found in Aldrete-Davila's pelvis but not removed. The path of the bullet is clearly described as entering in the left side of the left buttocks, traversing the groin area, and lodging in the right thigh.

The records also indicate reconstructive surgery was performed on Aldrete-Davila the same day at the army hospital. Damage to the urethra required a catheter to be inserted. Aldrete-Davila was placed under anesthetics for the operation and was heavily sedated for pain.

The drug smuggler was released from the army hospital the same day and given to the protective custody of Sanchez, who also took with him the bullet fragment removed from Aldrete-Davila's thigh.

WND has learned Aldrete-Davila spent the night of March 16, 2005, at the home of Sanchez.

"Christopher Sanchez shows up again with the shell fragments from Aldrete-Davila's body," Ramirez pointed out to WND. "Sanchez was evidently Aldrete-Davila's handler and from the looks of it, he did a good job. Taking that bullet home broke the chain of evidence. From there on, what good would a report be even if it established the bullet was fired from Ramos' gun?"

WND previously reported that the weapons identifications ballistics analysis performed by the Texas Department of Public Safety on the bullet fragment held by Sanchez did not match the bullet to the weapons fired Feb. 17, 2005 by Ramos or Compean.

March 16, 2005, was also the date "Osvaldo" Aldrete-Davila signed and accepted his offer of immunity from Sutton's office, supposedly signed before the medical operation was performed and the border pass issued. There is no time stamp noted on the immunity document nor mention of the location where the document was signed.

As WND reported, Sanchez grew up with Aldrete-Davila in Mexico, and the drug dealer's identity was first discovered through these family connections.

WND repeatedly has noted many of the DHS investigative reports were filed by Sanchez, who appears to have played a major role in the DHS field investigation.

"There was no reason to have redacted Christopher Sanchez's name from the report," Ramirez told WND. "Sanchez was a DHS special agent. But everywhere you look, Sanchez shows up playing a role shepherding the drug dealer around and framing the evidence that ended up being used by Johnny Sutton to put Ramos and Compean in prison for 11 and 12 years respectively."

The smuggler wouldn't have answered, because it would have been a death sentence. Sutton had no leverage over the smuggler to make him testify, because there was NO EVIDENCE tying him to the drugs, and no evidence even putting him at the scene of the shooting without granting him immunity to testify about it.

Compean and Ramos were no help at all, having been unable to identify in any way the man they chased around and shot at. They said they couldn't identify him. If they had gotten with police and done a drawing of the man, and told the supervisor what happened, and provided the information so the supervisor could write up the incident, collect the evidence, and put the drawing of the suspect in the record, then when the story of a shooting came to light by way of Rene, Sutton could have sent the picture to Rene and asked if it was a the person she was talking to. If so, they wouldn't have needed immunity, they could have used the picture and the words of the mothers to get extradition, and then Compean and Ramos could have identified him in a lineup.

But none of that happened because Compean and Ramos were more interested in not getting into trouble for shooting at the guy than they were of helping to catch a drug smuggler.

Of course, they can do no wrong, so this fact will be ignored and ridiculed.

Hold on there. The drug dealer ran away across the border to Mexico. If the guy wanted the bullet taken out of his a$$, don't you think they have doctors in Mexico? BTW, wasn't he taken by Sanchez to a US Air Force base and US Air Force doctor after Sanchez went to Mexico to retrieve the poor "victim"??

There seems to be some that don't care whether the two are guilty or not, they think there never should have been an investigation.
Well don't stop there, name names! At least give those whom you've slighted so backhandedly the opportunity to rebut your accusation.

The same night they had a rather negative report on the ability of our troops to avoid getting shot down in helicopters. But you have to take the good with the bad, I suppose. Dobbs also wants to socialize the oil companies because they overcharge us for gas.

Are there no pro-bp agent folks who, even though they want the agents freed, find it unacceptable to accuse the sitting Attorney General of the United States, a former Texas Supreme Court Justice, of being the recipient of drug money?

I thought there was a familial relationship, and we already knew it (brother/sister?). Am I mis-remembering?

There is so much mis-information thrown around by the BP agent defenders that I simply can't keep up anymore. Apparently our Attorney General comes from a family of drug-runners, and Chris Sanchez is sleeping with either Rene Sanchez his sister, or maybe he's having an affair with the drug smuggler or something. I'm so confused.

There are too many names. It is getting confusing. I think this is a summary of event and persons leading up to the start of the legal complain:

Cast of Characters

Rene Sanchez is BP Agent in Wilcox, AZ
Christopher Sanchez is DHS Agent in El Paso, TX
Osbaldo Aldrete-Davila is the drug-smuggler
Marcadia Aldrete-Davila is smuggler's mother
Georgia Toquinto who is mother-in-law of Rene Sanchez and friend of smuggler's mother Marcadia

1. Osbaldo gets shot in the butt [does this qualify him for a Purple Heart?] and manages to get to him home in Mexico

2. Osbaldo doesn't seek medical attention or notification to authorities.

3. Osbaldo's mother Marcadia contacted Gregoria Toquinto, who is mother-in-law of Rene Sanchez, and told Gregoria of the shooting

4. Gregoria contacts BP Agent and son, Rene, in Arizona

5. BPAgent Rene talks by phone to Osbaldo who is still in Mexico

6. BPAgent Rene contacts DHS Special Agent Christopher Sanchez who is in El Paso.

7. DHS Special Agent Christopher tells Rene to tell Gregoria to tell Osbaldo to contact him ASAP.

8. Osbaldo is told or taken to get medical attention in Mexico. He is treated, but the bullet fragments are not removed.

9. Later, DHS Special Agent Christopher Sanchez takes Osbaldo to get the bullet fragments removed in El Paso. Christopher also takes custody of the bullet fragments [breaking the chain of custody]. Christopher takes Osbaldo home with him under protective custody.

This case gets stinkier by the minute. Taking the bullet fragment home!!! That alone should have prevented this case from ever going to trial!

Actually, it looks like Sanchez should have been the one on trial!

His fingerprints were all over the van with the 743 lbs of marijuana in it. Is that evidence enough?

Don't hold your breath waiting for a coherent reply. He's far more interested in defending everyone involved in this case, including DHS and this Administration, as opposed to voicing some healthy skepticism.

THanks. I imagine that "parole" in this case has a meaning not related to "parole" as granted to convicted felons. Beyond that, I'm not sure what people think the significance of this is. It says he had access until 4/15/2005 (or maybe 4/18, hard to read). He was required to surrender it at the border when he left -- do we think he didn't?

Since the trial was in 2006 I presume he had other passes assigned to him for other visits, and that this was for his initial visit and interviews.

I think though I understand now the problem with my prior use of the term "visa". "Visa" in addition to being a term a lot of ignorant people like me use to indicate permission to be in the country, is also a technical term for a type of access granted to our country.

I apologize for all the kerfluffal about that last week. I simply never understood the point you were making, and now I do. I still don'w know what "public interest parole" means, but I presume that was what you were getting at, that a "public interest parole" is different from a "temporary visa", and I'll concede that point.

I don't know remember ever seeing that.

There is so much mis-information thrown around by the BP agent defenders that I simply can't keep up anymore.

There has been a fair share of misinformation thrown out by the anti-BP Agents as well. Start with our very own Office of the Inspector General.... and funnel on down to the MSM and then to a lot of folks on FR spewing the same garbage.

I love yesterdays headlines Report Concludes BP Agents Lied. Of course, if they actually read the report, they would have found it was just reiterating the same garbage from the smuggler and that it was authored by the same lying OIG Official that told lies to the Congressmen. Culberson is calling for her to be fired. I think she should be prosecuted.

I seriously doubt it. Bush doesn't "have to" do much. He has shown every indication of letting these guy rot in jail where the Mexi drug gangs can kill them.
