For Border Patrol Agents Joe Compean and Ignacio "Nacho" Ramos, February 7, 2005 was just another day of endless watching and waiting for illegal immigrants to cross the Rio Grande into the U.S. But catching illegals was a piece of cake compared to their battle against the drug cartels who are better-armed and whose foot soldiers outnumber them.

Over the last ten years or so, agents have been involved in a growing number of gun battles with drug runners on this side of the border. To say the least, the bad guys are getting more brazen and trigger-happy. So far, at least four smugglers have been killed. Our guardians of the Border have suffered no casualties. But the thought is always there: "Is this gonna be my day? Will I make it home tonight?"

Just what lala land are you living in? Haven't you been reading any of the details of this case? For crying out loud! Tony Snow even put fourth the lame excuse that the court recorder wasn't up to the task as an excuse for why the trial transcripts are still unavailable a year after the trial. Please!

This account skips a few small details, like the jury voted 12-0 that they were guilty, that no weapon was found, that they tried to hide the evidence, that the border patrolman that blew the whistle on these two lived in Arizona and didn`t know them but was offended by there actions,no account I read ever said there was a scuffle, and that both men were caught lying in court. Nobody likes illegals or drug runners, but we can`t give cops of any kind the right to shoot at people without cause. A jury of 12 Americans listened to all the testimony and convicted them. The judge followed federal guidelines and sentenced them. They have the right to appeal. Case closed. (describe the shooting to any experienced police officer and ask them what they think)

Where to start...

no weapon was found... because the smuggler escaped to Mexico therefore there is no way of knowing whether he had a gun or not. The border patrol agents testified they believed they saw a gun in his hand before they fired shots. The drug smuggler says he didn't have a gun. Family members of the drug smuggler say he always carried a gun. Which is credible?

they tried to hide the evidence... BP Agent Compean picked up his shell casings and threw them in the adjacent canal. Whether he was trying to "hide" anything is arguable.

the border patrolman that blew the whistle on these two lived in Arizona and didn`t know them but was offended by there actions.... The Az BP Agent (Rene Sanchez) had known the drug smuggler since he was a youth. The Az BP Agent aided the smuggler in hiring an attorney to file a claim against the US Government, crafting his story, and attaining an immunity deal. The Az BP Agent was given immunity by the U.S. Attorney for his testimony, in which he testified as a character witness for the drug smuggler.

no account I read ever said there was a scuffle... Several border patrol agents testified that BP agent Compean had been assaulted by the drug smuggler. Compean had a cut on his face and his hands were bleeding. The Supervisor failed to report that assault, as required by BP procedures.

both men were caught lying in court.... Please provide a source and detail as to what they lied about in court. I have seen no such allegation in all of the articles and press releases about this incident. According to the indictment, the charges against the agents were for 1) picking up the shell casings thereby a) impeding their use in a proceeding and b) altering the "crime" scene and 2) failing to verbally report to supervisors the discharge of a firearm which a) impeded a contemporaneous investigation surrounding the shooting and b) impeded the generation of a written report (as required of the supervisor).

Nice ad! I hope things like that would *put to bed* the notion or let's say myth, that people who are concern about border security, are anti-Hispanic. All three of these guys are Hispanic and most of us want justice for them.

Are you insane? Gag orders and sealed testimony seem to be the order of the day in this case. What the hell are you talking about? We are not talking about national security issues here other than the fact that are borders are like a sieve. Why is anything about this case classified? Documents supplied to the Congress of the United States have been redacted. Why?

You got your facts mixed up.

Border Patrol should have the right to shoot those who cross the border illegally. Actually, our military is more needed on the border than in Iraq.

Look it up to see how well this guy was treated and what he did after he was granted immunity, that the Jury wasn't allowed to see...

The jury was given criminally wrong instructions by the judge according to three sworn statements by those three jurors.

What was worse to me was to hear Tony Snow defending Sutton. Hugh Hewitt was not having any of it .. but Tony wouldn't listen.

Sutton has said there is no gag order. Will his word turn out to be as good as Nifong.

Remember what Nifong wrote about the DNA. The gentlemen from the lab proved that wrong.

There are too many conflicting stories. The family says there is a gag order, the prosecutor says there isn't.

As for the transcripts, they aren't ready. Some congressmen have asked for them and were told they weren't ready. So I don't know what or who to believe.

If you agree with the jury, then you agree with the case the prosecutor gave. I bet the truth is somewhere in between.

That border patrol agent passed false information to the DHS investigator. The original story as documented in the March 14 OIG report was that the dealer was shot while trying to cross the border from Mexico to the United States and that he was shot in the groin. That was false. Further, there was no mention of the chase, being nearly hit with the butt of a shotgun or that the dealer was unarmed.

Either the dealer lied to his life-long friend, or Rene Sanchez was party to passing on false or incomplete information to a law enforcement authority. How different is that from Compean and Ramos's failure to document the discharge of their guns in their report about the marijuana found in the van? Shouldn't Rene Sanchez be investigated for obstruction of justice?

After all, the March 16 immunity agreement was based on the March 14, 2005 OIG report--which contained lies and omissions.

The truth may be some where in between what each side says, but, it`s tough to discount what the jury decided. It isn`t like OJ where the jury closed their eyes and voted the way the did because of race. And it isn`t like the Duke case because competent attorneys can stop a nutty prosecutor. This case is going to be appealed and, lets see what happens there.
