For Border Patrol Agents Joe Compean and Ignacio "Nacho" Ramos, February 7, 2005 was just another day of endless watching and waiting for illegal immigrants to cross the Rio Grande into the U.S. But catching illegals was a piece of cake compared to their battle against the drug cartels who are better-armed and whose foot soldiers outnumber them.

Over the last ten years or so, agents have been involved in a growing number of gun battles with drug runners on this side of the border. To say the least, the bad guys are getting more brazen and trigger-happy. So far, at least four smugglers have been killed. Our guardians of the Border have suffered no casualties. But the thought is always there: "Is this gonna be my day? Will I make it home tonight?"

Can you share the story of Gilmer Hernandez? I'm not familiar with the case.

It would seem the"system" is so corrupt, it's not even funny anymore........how to fix? (arghhhhhhhhhhhhhh)

This account skips a few small details, like the jury voted 12-0 that they were guilty, that no weapon was found, that they tried to hide the evidence, that the border patrolman that blew the whistle on these two lived in Arizona and didn`t know them but was offended by there actions,no account I read ever said there was a scuffle, and that both men were caught lying in court. Nobody likes illegals or drug runners, but we can`t give cops of any kind the right to shoot at people without cause. A jury of 12 Americans listened to all the testimony and convicted them. The judge followed federal guidelines and sentenced them. They have the right to appeal. Case closed. (describe the shooting to any experienced police officer and ask them what they think)

Isn't it true that the prosecutor has not entirely honest in what he provided to the jury about the smuggler.

If the case was so open and shut, why is there a gag order and the transcripts of the court case not been released after a year.

I'm not sure what to believe.

Mexican Drug Dealer to Sue U.S.

The drug smuggler shot by two U.S. Border Patrol agents is planning to sue the federal government for $5 million. Walter Boyaki, the El Paso, Texas-based attorney for Osvaldo Aldrete-Davila, said he will sue the government for wrecking his client’s business.

“Osvaldo was making $100,000 a month from his export/import business,” Boyaki said. “Now he is laid up with an embarrassing and incapacitating injury. We are seeking both compensatory damages for lost profits and punitive damages for the indignities Osvaldo has suffered.”

Border Patrol Agents Ignacio Ramos and Jose Compean recently began serving prison sentences after being convicted of shooting Aldrete-Davila. The pair encountered the drug smuggler in February of 2005 driving a van containing 743 pounds of marijuana. When the Mexican tried to flee, the agents shot him in the buttocks.

“They violated my client’s rights,” Boyaki said. “And the damages are mounting up. He’s got customers whose deliveries have been interrupted. This is trashing his business reputation and endangering future sales. His employees are too frightened to carry on in the climate of violence created by out-of-control border guards. They are demanding raises. His family has had to cancel their European vacation. He has no money to buy gifts for his mistress. It’s a real tragedy.”

"The jury voted 12-0...." But three jurors subsequently filed affidavits saying they wanted to acquit but were bullied/misled into thinking they HAD to vote to convict. These agents are being railroaded by a corrupt prosecutor who is doubtless in league with the cartel sponsoring the illegal smuggler who pointed what the agents though was a weapon at them. This a Nifong style corrupt prosecution. The agents must be freed forthwith.

I'm with you, and as far as the infallibility of a 12 man jury, having seen the O.J. Simpson trial I'd say that argument was blown to hell !!!

It is confusing but, lot`sa people , good ones all, don`t like drugs or illegals and are so steamed up about them, that they are willing to give these agents special rights. Till it`s proven other wise, I`m with the jury. As to a gag order, I`ve heard Sutton, the Federal Prosecutor, discuss the case on the radio, I know he`s been on Fox, and he put out a statement on the Internet that has been posted here. That tells me there is no gag order. The defense got copies of the transcripts probably before the ink dried. Because the smuggler hadn`t been convicted of any thing,that could be mentioned in Court.

Write Bush at: president@whitehouse.gov

They need to hear our outrage that neither of them has moved a muscle to pardon these border patrol agents who we pay to do their jobs.

Your statement here is exactly the same kind of logic that puts two border guards in prison for 12 years for shooting a Mexican drug dealer in the ass. When people bring up George Bush in connection to this case it's his open border policies and the subsequent policies of federal agencies like the Border Patrol that take their cue from his misguided leadership we're talking about.The drug dealer was a Mexican here illegally,moving narcotics across our border and while you and the 12 man joke don't think these guys could tell what they were dealing with,after a combined 15 years or so years doing this work I happen to believe they knew EXACTLY what they were dealing with.But hey,the good news is your happy,ALL the drug dealers on both sides of the border are happy and the two big,bad border guards are in prison for the next twelve years.If this is what the Constitution is about,screw it !!!

And you sure don't see anyone in Washinton stepping up to the plate, on behalf of the two American citizens here do ya??? Why is the drug smuggler also not sharing a cell with the two agents??? Oh, I forgot. He is an illegal and our government has said "HANDS OFF OF ILLEGALS" --- this is what you get when you have an administration that supports foreigners more than American citizens...

He escaped back into Mexico and was picked up by a waiting vehicle. There is no possible way to know if he had a gun or not. As the article notes, his wound is consistent with someone left handed, as this dirt bag was, turning to aim a weapon. Just take your cup of Koolade and wonder off.

I have reluctantly come to the conclusion that Bush is a Globalist pushing the North American Union agenda in stealth mode. The majority of the sheeple in the US wont know about it until it's a done deal. I voted for this guy twice. I know better now. See my tag line.
