"Leader of missionary couple abductors confirmed dead"
By Noel Tarrazona
Special to ASSIST News Service
ARTICLE SNIPPET: "ZAMBOANGA CITY, PHILIPPINES (ANS) -- Kaddafy Janjalani, the leader of the Abu Sayyaf Group who abducted American missionary couple Martin and Gracia Burnham in 2001, was confirmed dead by Philippine and U.S. authorities who conducted forensic examination two weeks ago.
Janjalani was killed in a gun battle with Philippine soldiers in the jungles of Patikul, Sulu which both U.S. and Philippine governments described a successful campaign against global terrorism.
The Burnhams were abducted at Dos Palmas in Puerto Princesa City in May 27, 2001 and were held captive for more than a year. Gracia was rescued by Philippine soldiers while her husband Martin was killed in the rescue operations. The couple was working for New Tribes Mission.
Two things could happen after the Abu Sayyaf top leader Kaddafy Janjalani was killed in a 30-minute gun battle in the jungles of Patikul, Sulu. Either it will finally end the 15-year terror activities in Southern Philippines or the group will even be stronger to take vengeance against Philippine and U.S. governments whose joint efforts were responsible for the death of their leader, who had a 5 million dollar reward on his head.
These possibilities are now under study by both RP and U.S. authorities as part of their global campaign against terror. Military intelligence reports disclosed that the Abu Sayyaf is now working as to who will succeed Janjalani and the following names were already considered as possible successor Radullan Sahiron, a one armed fighter who is already in his 70s, Abu Pula, the groups strategist who is in his 50s, and Isnilon Hapilon, who was responsible in the kidnapping of three Americans and 17 Filipino tourists in Palawan resort in 2001.
However, Armed Forces of the Philippines Chief of Staff Hermogenes Esperon said that the Abu Sayyaf will have a hard time looking for a leader as strong as Janjalani since there is no viable leader that could provide the same kind of Janjalanis leadership.
Moreover, the US government upon learning the death of Janjalani, lauded President Gloria Arroyos administration in her support to US campaign against global terrorism. The U.S. military support also has been instrumental in neutralizing the Abu Sayyaf."

Terrorism: Al-Qaeda Web Monthly Back After Year's Break
ADN Kronos International ^ | Feb. 10, 2007 | News

After more than a year's absence, the jihadi propaganda monthly "Voice of Jihad" (Sawt-al-Jihad), edited by the Saudi cell of the al-Qaeda terrorist network, has reappeared on the Internet. The new issue - the 30th - opens with an editorial threatening the Saudi regime and welcoming the birth of "an Islamic emirate" in Iraq by local al-Qaeda cells. "Voice of Jihad" was launched in 2003 covering mainly ideological and doctrinal issues concerning the mujahadeen in the Arabian Peninsula.
"As for us, we have begun a new year and we ask Allah that it be a year of victory," reads the editorial. For some time now we have been preparing important operations which will make the crusader (i.e. American) bases on the Arab peninsula tremble and the aim of the mujahadeen will be to cleanse the peninsula of the pagans and the crusader bases" - a reference to US military posts in the region.
The editorial concludes with a message to the leader of al-Qaeda, Osama bin Laden. We say to our emir, Sheikh Osama bin Laden, that we will continue on his path. Your soldiers are working, planning and preparing something which will make him and all true believers very happy. We pray to Allah that all will go well until the arrival of zero hour," it added.
The magazine also carries a claim of responsibility for an attack by Islamist terrorists against a Saudi oil refinery at Baqiq, on 24 February 2006.
It concludes with an interview with a doctor of Moroccan origin living in France, who in the 1990s decided to fight alongside the Bosnian mujahadeen, and a corner dedicated to readers, who are invited to write to the jihadi publication on the site http://contactus.arabform.com

"Court Blocks Suspect's Transfer to Iraq
Appeals Court Blocks American's Transfer to Iraq for Trial on Terror Charges"

US Court of Appeals in DC claims Iraqi jurisdiction
MICHAEL J. SNIFFEN Associated Press Feb 9, 2007
WASHINGTON - A federal appeals court blocked the Pentagon on Friday from transferring an American citizen to an Iraqi court to face charges he supported terrorists and insurgents. A three-judge panel of the U.S. Court of Appeals for the District of Columbia unanimously ruled that Shawqi Omar, a citizen of both Jordan and the United States who once served in the Minnesota National Guard, has a right to argue for his release before a U.S. court. By a 2-1 vote, the panel also upheld an injunction issued last year by U.S. District Judge Ricardo Urbina here that barred the U.S. military from turning Omar over for trial in an Iraqi court
Voicing disappointment, spokesman Erik Ablin said the Justice Department believes the decision "will inappropriately interfere with the executive branch's prerogative to prosecute a war and to make good on its commitments to our allies." He noted the partial dissent called the ruling unprecedented and said it would effectively block a foreign government from making an arrest on its own soil
Omar was captured in Iraq in 2004 by U.S. forces during a raid on associates of Iraq al-Qaida leader Abu Musab al-Zarqawi, who was killed in a U.S. air strike in 2006. Omar is imprisoned at Camp Bucca, in southern Iraq. He was been held in several camps for over two years without formal charges and, his family says, without access to counsel. The U.S. military says Omar was harboring insurgents and had bomb-making materials at the time of his arrest. The military decided in 2005 to transfer him to the Central Criminal Court of Iraq for trial but has been blocked by the U.S. court injunction

PUBLIC INFORMATION OFFICE

U.S. CITIZEN CHARGED WITH TRAINING TO FIGHT JIHAD IN SOMALIA
(HOUSTON) A United States citizen has been arrested and charged with receiving training from a foreign terrorist organization and conspiring to use an explosive device outside the United States, Don DeGabrielle, United States Attorney for the Southern District of Texas; Kenneth L. Wainstein, Assistant Attorney General for the National Security Division of the Department of Justice; and Joseph Billy, Assistant Director of the Federal Bureau of Investigation Counterterrorism Division, announced today.
Daniel Joseph Maldonado, a.k.a Daniel Aljughaifi, 28, a former Houston resident, was returned to the United States late last evening from Kenya to face the criminal charges pending in this district. Maldonado was captured by the Kenyan military on January 21, 2007, as he fled to avoid Ethiopian and Somalian forces. Expelled by Kenyan officials, Maldonado was turned over to American authorities over the weekend and flown to Houston accompanied by special agents of the Federal Bureau of Investigation. He appeared before United States Magistrate Judge Calvin Botley this afternoon and has been ordered detained without bond pending a detention hearing set for Tuesday, February 20, at 2:00 p.m.
"Any who seek to aid terrorists in their mission to threaten our national security will be held to account for such serious criminal conduct," said United States Attorney Don DeGabrielle.
"This case represents the first criminal prosecution of an American suspected of joining forces with Islamic extremist fighters in Somalia. The prosecution of Mr. Maldonado demonstrates the scope of our laws and serves as a warning to others who would travel overseas to wage violent jihad," said Kenneth L. Wainstein, Assistant Attorney General for the Justice Department's National Security Division.
Joseph Billy, Assistant Director of the Federal Bureau of Investigation Counterterrorism Division, said, "The FBI is working closely with our law enforcement and intelligence community partners in this country and around the world to bring all necessary resources to bear to protect Americans and its allies from terrorist attacks."
According to allegations in the criminal complaint, Maldonado traveled from Houston, Texas, to Africa in November 2005 and then on to Somalia on or about December 2006 to join the Islamic Courts Union (ICU) and elements of Al Qaeda, to fight "jihad" against the Transitional Federal Government to establishment of an independent Islamic State in Somalia. In the fall of 2006, the ICU used suicide bombers and vehicles containing improvised explosive devices to target the leadership of the Transitional Federal Government of Somalia.
While in Somalia, Maldonado was, according to the complaint, provided an AK-47, equipped with military combat uniforms and boots in Mogadishu, and participated in training camps in Kismaayo and Jilib, Somalia. The camps included physical fitness, firearms, and explosives training all in preparation to go to the front to fight for the ICU. Al Qaeda members were allegedly present at the training camp. During the course of his training, the complaint alleges Maldonado spoke to an individual about his willingness to become a suicide bomber if he was wounded and also observed the making and testing of bombs with the group's bomb-maker.
Conspiring to use a destructive device carries a maximum penalty of any term of years up to life imprisonment upon conviction. Receiving military training from a terrorist organization carries a maximum punishment of 10 years imprisonment upon conviction.
The investigation leading to the filing of criminal charges in this case was conducted by the Joint Terrorism Task Force including special agents of the Federal Bureau of Investigation and officers of the Houston Police Department. The case will be prosecuted by Assistant U. S. Attorney Gary Cobe.
A complaint is an accusation of criminal conduct, not evidence. A defendant is presumed innocent unless and until convicted through due process of law.

Thank you Nick Grace from GLOBAL CRISIS WATCH (http://www.globalcrisiswatch.com ):
QUOTE:
Dr. Abdiweli Ali on Global Crisis Watch, January 8, 2007:
http://www.globalcrisiswatch.com//gcw/gcw_070108.mp3
"There was a call by the ICU for interantional Jihadists to come to Somalia to fight the war and a lot of international Jihadists... heeded that call and among them were some Western nationals. The top echelons of the ICU are, for example, American nationals. The Secretary for Foreign Affairs of the ICU, Ibrahim Hassan Adow, is an American national. The head of the reconstruction for the ICU, engineer Umar Aftoche, is an American national. So it's no secret that there are foreigners in the upper echelons of the ICU."
Global Crisis Watch, January 15, 2007:
http://www.globalcrisiswatch.com//gcw/gcw_070115.mp3
Ismail Hurreh, TFG FM: Some of the people captured - foreigners brought to the vicinity of Kismayo - is about 290. People from all parts of Asia, from the Arabian Peninsula, from Pakistan, from Afghanistan, and from quite a number of other places. There are definitely certain Europeans also being called as prisoners. I know of 5 Scandinavians, I know of 3 Brits, I know of at least 1 Canadian, 1 Swedish. There are many, many Oromos and Eritreans. At least 60 Oromo are now in custody, 30 Eritreans at least are in custody. There are people from the Comorro islands, from Zanzibar. So it becomes very clear that this was an international Jihadist adventure.
Nick Grace: Clearly the scope of the foreign fighters on the ground is massive. Are we talking about Somali-born Westerners or are these white Europeans that have been captured?
Hurreh: These are white Europeans, Asians. For example, of the 290 only 50 are Somalis - whether they are Somalis that have taken residence somewhere else or not. The rest are all foreigners. The majority are Asians but there definitely are Europeans.
