Truly a sad story. The kid was by no means an angel, but 10 years for oral sex with another teenager??

"When he was a senior in high school, he received oral sex from a 10th grader. He was 17. She was 15."

Bzzt. Sorry. Lock him up. Stat rape is stat rape. He violated the law. Period.

In NY, there's an exception to the Stat. Rape statute [which is normally an 'E' felony, with a max of 1-4, and the possibility of straight probation], based on the fact thathe's less than 21.He would have been charged with a Class 'A' misdemeanor, and faced 1 yr., county time, max.

Maybe you didn't read this far...

"But because of an archaic Georgia law, it was a misdemeanor for teenagers less than three years apart to have sexual intercourse, but a felony for the same kids to have oral sex. Afterward, the state legislature changed the law to include an oral sex clause, but that doesn't help Wilson."

And really... TEN YEARS in state prison??? We have murdering mothers in Texas who get less time than this.

Here in Alabama, the age of consent is 16 but if one is within two years of the minor's age he cannot be charged with statutory rape. I know many states have similar provisions.

The sentence in this case is simply idiotic. If this was universally enforced in this way I believe sixty percent of the Army Infantry and the Marine Corps would be behind bars.

He wasn't charged with statutory rape.. he was charged with "aggravated child molestation".

At the very least tens of millions and probably more than a hundred million Americans would be in prison, or on sex offender roles, if every one of them who fooled around as a minor with a minor in this sort of way was charged. Its beyond crazy.

Wrong.Read the whole article. Not when a teacher in the same state gets 90 days for molesting a student or if the young man had intercourse with the same 15 year old it would have been a misdemeanor. On the federal level, Sandy Burglar can get away with stealing top secret documents with a slap on the wrist. Something is drastically out of kilter with our justice system at all levels.

I say leave room in prison for serious violent offenders. In this case there was no forced assault. I'm sure guys who have done a lot worse have had lighter sentences.

Sounds like another out-of-control DA. The adversarial justice system and the job of DA have got to go, there has to be a better way to do justice.

Don't do the crime if you don't want to do the time.

If this was a boyfriend/girlfriend situation, I might agree. However with the 15 Y.O. girl being supplied booze, it looks like rape and child abuse to me...

Perhaps you should just speak for yourself... Do you really believe that 60% of our military men supply alcohol to 15 year old's and have sex with them?

That's crazy talk...

If you give a kid booze and then have sex with him/her, it's rape not statutory rape.

Stat rape is stat rape

I thought 17 was still considered to be a minor, so how could it be stat rape?

Everyone, including the girl and the prosecution, agreed she initiated the act.

I'd like to know how many 17 year olds out there are going to refuse an offer like that.

No problem. We have it on Presidential authority that oral sex is "not sex"...

(Need I add that the president was Bent Willie...?

He wasn't charged with statutory rape... he was charged with aggravated child molestation. Indeed, when the jurors found out there was a 10-year mandatory minimum sentence, several were incensed. The prosecution told them to write a letter, then moved on to the next case.

I bet if Mr. Barker's teenage son got a blowjob from a 15-year old girl, he wouldn't be sending him to prison for 10 years.

I bet a heck of a lot of them got drunk and fooled around with a minor while they were minors themselves.
