President Bush is expected to reach out to the families of two Texas Border Patrol agents convicted of shooting a Mexican drug smuggler.
White House staff contacted former agent Ignacio Ramos' family early Friday, assuring them the president would call them soon, said Monica Ramos, the agent's wife.

"Oscar Juarez was one of the agents given immunity from prosecution because he admitted lying three times on three prior statements during questioning. Now, what could he be lying about I wonder...."
I say they both attempted to cover then Juarez, turned and told the truth.

It looks like it. It appears he attempted a coverup also, but turned fed's witness. Looks like he backs up the supervisor. Loya doesn't mention him, so his testimony was probably had a very incriminating result.

Border Agents Ignacio Ramos and Jose Alonso Compean were on duty when they spotted what they suspected was a drug smugglers van near the Rio Grande. It turns out that their instincts, honed by many days on that border, were correct. The van contained 743 pounds of marijuana. Driving the van was an illegal alien, Osbaldo Aldrete-Davila.
It's their job to spot illegal aliens, and they spotted him. As far as the gun casings go, the supervisor knew their guns were fired and didn't make a big deal of it since they all figured that no one was shot.You might find this bit of info interesting....Ramos related that none of the other agents who had responded to the scene had filed reports that shots were fired and that both supervisors knew that the agents had fired their weapons. Nonetheless, Compean and Ramos were singled out for prosecution.

All of this will come out in the wash eventually, and I believe they will go free and have it all expunged.

I wonder how a border agent, or anyone for that matter, can tell who is an illegal alien just by looking at them. There are so many Mexicans that are legal citizens now, and green card carrying foreigners so it must be difficult to tell the illegals apart from the legal ones just by looking at them. I can't even imagine how one would be capable of doing that.
I certainly hope that this isn't a case of the agents being made an "example of". An example of what? Our border agents are detaining and/or arresting illegal aliens every day. If I understand this correctly there were several shootings of illegals last year, including 4 deaths. However, in those cases the border agents followed the rules, reported the events, and none of them (as far as I know) received any reprimands, let alone charges against them.
That is interesting, if true, that the other agents who responded to the scene did not file reports showing that shots had been fired. Wasn't it their duty to do so since they are supposed to report the facts? If this is true, I would imagine that those agents must have been reprimanded. Do we know their names yet?
"The trial testimony of the defendants, fellow Border Patrol agents who were on the scene and who arrived shortly thereafter, as well as taped radio communications showed that there were no supervisors at the scene at the time of the shooting. The agents knew they must report any discharge of a firearm and had just received training to this effect the day before this shooting. Further, Agent Ramos was a Border Patrol firearms instructor and a member of the evidence recovery team. He was well aware of this requirement as he had taught this to other agents. They did not report the discharge because they knew the shooting was not justified. Furthermore, based on their training and experience, they were aware of what law enforcement resources would be dispatched to the crime scene to investigate a shooting, including sector evidence team, the Federal Bureau of Investigation, and state and local law enforcement.
According to this information, there are "taped radio communications" showing that there were no supervisors at the scene. So unless the agents reported the shooting (which we hear they did not...and also hid the spent cartridges), then how are we to assume or believe that the supervisors knew. If the supervisors did know, and they also were negligent in reporting this, they should be reprimanded as well.

No both Loya and Sutton refer to him by his name Juarez. Sutton also refers to another agent at times which maybe Juarez. Not enough info out there to keep thinks straight with all the bits and pieces that dribble out.

The only Loya I've heard about is the FIL of one of the agents. Is there another, Loya?

I get the sense that they really weren't trying to kill the drug smuggler. They were trying to stop him, arrest him.
