The thing is, the DA didn't have to prosecute this case; he has the discretion to NOT bring charges if it's in the public interest.

Was shooting a foreign drug importer - who illegally snuck into the country - in the ass really that big a deal?

MYTH: Those who defend and attempt to protect our OPEN borders are lawbreakers.

Truth: Border Patrol Agents who attempt to keep stinking illegals and their illegal drugs out of the hands of young AMERICANS are convicted for DOING THEIR JOBS!!!!

Why would the President commute their sentences. Doesn't anyone think he sanctioned this prosecution?

Two patrolmen in Montana stopped a truck and, holding the driver, who had not resisted. At this point the driver was only stopped because he looked suspicious, As the Patrolmen attempted to handcuff the driver, still not accused of anything, one patrolman fell, the driver turned and ran toward the Canadian border as a patrolmen fired at the fleeing man, till his gun was empty and he continued to shoot, missing the driver. The second patrolmen fired once, hitting the driver in the rear. At no time did the driver threaten the patrolmen.
The two patrolmen do NOT pursue the driver, instead clean up their brass and DON`T report the incident. They get caught, have a trial, and after only two and a half hours are convicted and sent to jail.
That is basically what happened. Now, cause the President won`t pardon these two liars, Mr Bush is a trader and should be impeached? Do we really want cops or border patrol agents acting as unsupervised judges and juries, shooting at people that are no threat to them? Should the President grant pardons to those that attempt to kill those that we don`t like. If so, maybe Sadammn has a cousin that would like to run the country.

Compean said, "I feel betrayed by the government. My entire adult life, I've been doing nothing but working in the government. My four years in the military, and five years in the Border Patrol. I've done nothing but protect this country, and this is the way I get repaid."

depriving the ILLEGAL ALIEN CRIMINAL INVADER smuggler of his Fourth Amendment right to be free from illegal seizure.

He was an ILLEGAL CRIMINAL INVADER committing an ILLEGAL act in a country he INVADED ILLEGALLY. He has NO 4th Amendment rights.

It's really sad when two men who are protecting our country go to jail for it because the main point above anything else is political agenda. What does that say about our leadership. I truly hope our leaders are tortured by their consciouses and can not sleep at night.

Release them immediately.

That too is incorrect. This is from Joe Loya's letter to the Senator - the REAL STORY

"Because of the supervisor’s actions, none of the agent's filled out firearms discharge reports. This administrative policy violation could have gotten them a five day suspension without pay. After checking again on Compean’s condition and asking him if he wanted to file assault charges, according to testimony, Richards then made a statement saying, “If we call the F.B.I. we are going to be here all night doing paperwork. We will never know who the person was that assaulted you although we've got the van and the marijuana." After that, everyone went back to work. "

He also did not get shot in the ass as he fled.. see this doctor's testimony from the same letter:

"Davila claimed that he was shot in the back as he fled back to Mexico. The U.S. Army doctor who removed the bullet fragment from the smuggler's right groin disagreed. Although he was testifying as a government witness, he told the truth and stated, "The smuggler was not shot from behind". "He was in a running position, (bladed position) and pointing back with his left arm and hand when the bullet hit his left side of his left buttock and traveled to his right groin. The prosecution then suggested that he may have been shot as he was running across and not away from agent Ramos. The doctor disagreed and so he was quickly dismissed by the prosecution. "

Also this shows that Federal prosecutors had it out for the agents:

"At the trial, the drug smuggler claimed that Compean fired 5 or 6 shots at him. During the trial, the prosecution upped that number to 16 shots. "

It is CLEAR to anyone who knows the facts of this case that this case was a RAILROAD job by our Federal government and that fact will become completely clear on appeal when this is tried in a new court. I hope it goes all the way to the Supreme Court and I hope to GOD the agents get out of prison while awaiting the appeal process.

For GOD's sake OJ Simpson is walking around a free man and these good guys are in prison.

What kind of country are we living in????? Certainly not the one our founding fathers designed.

Also this shows that Federal prosecutors had it out for the agents:

All Federal prosecutors should "have it out" for agents that destroy evidence and lie on reports.

So much for the "conservative" George Bush, who fancies himself the new Reagan, but never vetoed a spending bill, is now withdrawing conservative judicial nominees, lets this total miscarriage of justice go forward, is intent on securing the frontiers of countries 10,000 miles away while totally ignoring protecting our own borders. Thanks for wrecking the Republican Party, Mr. Bush. You're no Reagan and never were.
