WASHINGTON (Reuters) - President George W. Bush has decided not to reauthorize the controversial domestic warrantless surveillance program for terrorism suspects and to put it under the authority of a secret special court, Attorney General Alberto Gonzales said on Wednesday.

Don't forget, this does NOTHING to preclude Bush from starting ANOTHER secret program that the Dems don't know about either, with safeguards in place to identify and punish leakers.

how do you figure that? how is it "on congress" now? I would agree with you, had CONGRESS challenged the constitutional authority of the President to bypass FISA, and won that case, then it would have been "on congress". But how is it "on congress" now, when the administration voluntarily agreed to restore FISA jurisdiction?
I pose the idea that this actually came from the Office of Disinformation (who's first memo was that the Office would not be created). ;)

the Dems could step up today, and de-authorize the FISA court. will they?
the Dems simply do not want use of executive power in this area, and that's been done away with now.
They can still hold hearings about the conduct of the program since 9-11 - and now they will be able to say "note that Bush himself decided to stop this illegal program". and what do republicans say in response to that? they've got nothing to say in retort now.

Excellent. Warrantless wiretaps are something that I don't like because they eliminate oversight and accountablity. Even having a rubber-stamp special court forces someone somewhere to sign a paper saying who they are, what they're doing, and why. That way if the system is abused, we can go back to find out who asked for what.
look, we know this adminisrtation is politically inept. but here was an issue that we were doing pretty well with politically (compared to iraq for example) - and we just gave it away.
I just read the AG letter, and it sure reads like capitulation to me. Mark Levin will explain it all later, but this sure looks like a white flag to me.
Bush ceded his right to executive power here. the FISA court, can be desconstructed or changed by congress tomorrow.
